“Comments?”
The California Supreme Court uanimously ruled in favor of liberty? Pigs do indeed fly!
But, of course, retard cops with room temperature IQs will continue harassing people who want nothing to do with them.
That’s insane.
The title makes it appear worse than it is, it doesn’t sound like a bad ruling if you read further.
Everybody will run from the cops. Why would the cops give chase anymore?
I always thought inadequate reason to stop someone.
Oh, dear God.
Might as well go all the way and say, people cannot be detained at all for breaking the law.
The future is no laws or rules or regulations at all. Bach to the future and the future is the cave ages. Anything goes.
I believe this obviously flawed decision will be overturned. Even the 9th circuit will see that this hampers law enforcement.
I believe that they ruled correctly. “You blinked like a guilty person. Stop and show me your ID.”
Cops must show a reasonable articulable suspicion that a crime has been committed before they can detain you or make you show identification.
If they don’t, you are under no compulsion to comply.
I actually agree, watched enough cop vids to know the flight instinct is strong, especially when everyone tells you they are gong to kill you when they catch you, wouldn’t you?
going back to the law of the jungle, which isn’t necessary a bad thing. under jungle law the bad guys usually don’t fare well and aren’t protected by double-standard, faux justice. under jungle law being rich and powerful doesn’t give one license to do whatever you want. cross the wrong person and KA-POW! jungle meat. just sayin’.
It was a good ruling, all because of the word “evade”.
What does that word mean? There’s the problem. It could mean anything a police officer wants it to mean. Some guy crosses the street. He’s evading. Stop him. Some guy turns around and walks the other way. He’s evading. Stop him.
Neither crossing the street nor turning around are illegal in themselves. They should not be used as a a reason to stop and detain someone. More is needed.
They got one right. I would think most Freepers, being anti-big government, would agree.
Avoiding the LAPD is a survival trait. It’s the correct thing to do.
They have just put innocent pedestrians/citizens in harm. FPOS
I agree with the decision. No one wants to interact with the police. Even if they are just going their merry way and committing no crimes. Police will use the excuse of “He looked nervous” or “he had his hands in his pockets” to stop and question someone.
If you see an officer and turn off to avoid the interaction, it doesn’t mean you are guilty of a crime. Maybe you just don’t want to take the chance that it is a cop with an attitude looking for a reason to make an arrest. And if they want a reason, they will find it.
Police are supposed to be aware of a particular crime and then look for the perpetrator. Not look at a guy and think “He might be a criminal, I better stop him and ask if he is walking down this street for legal purposes”.
How about circumstances matter! Consider a serial shooter at the mall or some other public place. Police arrive and notice a person hiding. You're telling me the police can't stop, detain and frisk that person? Circumstances matter!
Seems like a good ruling to me.
