Employers in Maine Can Ask Applicants if They’ve Been Vaccinated but Not if They’ve Been Convicted of Felonies

As our freedoms are weakened by vaccine authoritarianism, protections for the convicted darlings of the “woke” continue to increase. The latest example is Maine where a bill was just signed preventing employees from asking if someone has a prior felony conviction until… wait for it… they’re already offered them the job. They can, however, ask up front if an applicant has been vaccinated for Covid-19.

In essence, someone with a criminal record of violence or theft has a better chance of getting a job in Maine than someone who has acquired natural immunity to Covid-19 but who has chosen not to get vaccinated. That’s the direction society is heading, especially in blue states. According to Just The News:

Employers in Maine will be prohibited from asking prospective job candidates about their previous criminal histories under a new law signed by Gov. Janet Mills.

The new law, which was approved by the Legislature in the final days of its session, will ban companies from screening people with criminal backgrounds before those applicants have an opportunity to go through the preliminary hiring process.

Under the new rules, which take effect in October, employers must delay questions about a criminal history until after they’ve made a conditional offer of employment. After that, they can ask about criminal convictions, but not about previous arrests or charges.

There are also exemptions in the new law for situations where a previous felony conviction prohibits a prospective employee from being considered for the opening. Employers that violate the new rules, which will be enforced by the Maine Department of Labor, could face penalties of up to $500 for each violation.

Need to make not getting a vaccination a felony so that one has a loophole for this.

If any employer asked that question they would have twenty local, state and federal agencies parked on their door-step, and would be closed in a matter of days.

The reality is that employers have some questions that they can legally ask, and some questions they cannot legally ask.

Every employer has the natural right to ask, and condition employment on, anything they choose.

The reality is that employers have some questions that they can legally ask, and some questions they cannot legally ask.

Which part of "natural" did you not understand?

What is terrible is that if an employee commits a crime against someone while on duty or on the job, the employer may be held liable.

Having lived in Maine once & being employed there, I find it nothing to worry about as I would never consider even living there again if my life depended on it & thankfully it does not.

Business in Maine are desperate for employees. I doubt if the business owners care about vaccination status....40% of Maine residents are not vaccinated.

Business owners are pulling their hair out trying to hire people.

A local McDonalds is offering $805.00 per week plus money for tuition plus $1,000 towards health insurance.

So the Maine Dept. of Labor is really just saying that it’s OK to do a criminal background check, as long as you’re willing to pay $500 for it.

Or, you just start by offering every applicant a "conditional offer of employment" for $1 salary, with the condition being that you have to pass the hiring process. Then there is no fine, and you can continue the hiring process as normal.

Why? what part of that question is against the law to ask? What if the answer the company is looking for is "no"?

Companies can legally ask just about any question, the only issue is possible EEOC complaints if certain questions are asked, and some potential employees feel they were discriminated against because of those questions. Hiring discrimination is illegal, but asking those questions is not explicitly illegal. Just potential 'evidence' for an EEOC investigation.

Caveat here though, some States may have actually defined illegal questions, but nothing that I know of.
