He could file a malicious prosecution suit.
But if he didn’t attribute the picture taken inside of Congress to someone else, if he gave the impression that he had taken the photo, then the benefit of the doubt might swing to the FBI.

FedGov has 14,000 hours of video recording from in and around the WH for Jan 6th. Pretty easy to determine whether or not he went inside but the FBI is corrupt as we know.
