That’s not how HIPAA works at all. HIPAA applies only to covered entities, it doesn’t apply at all to non covered entities. There also isn’t a private right of action under HIPAA. You have to file a complaint and it’s up to the government to investigate and deal with it.

The very idea of a vaccine mandate or vaccine passports are fundamentally unAmerican. However, HIPAA isn’t your savior here.

This is my favorite part of throwing back the scolds onto their heels. I usually tell them, “Did you know that medical information for private citizens is covered by statute and regulated by the ADA (Americans With Disabilities Act) and that it is a federal offense to compel people to reveal their condition?”
“Did you know that you could be charged for harassment, discrimination, or even retaliation just for asking my status?”
It never goes beyond that point and people tent to give me wide berth.
Yes, I agree. It is routinely violated, by insurance companies, and now political operatives. No surprise at all.

I agree. We live in a world now here Truth is “whatever I say it is”. HIPPA protects me because I say it does. If anyone wants to challenge me on that, I say “I think I know the law better than you do”. If they want to pursue, I say “I’ve won the argument. Give it up. You’re just embarrassing yourself.”
Does HIPPA protect me? Do I know anything about the law? HA! Not likely! Does not matter. I declare victory and move on. That’s power. Seize the power.

Actually, most people trolling abut for this information are not subject to HIPAA.
Just say, “Yes”. No need to say it’s the shingles or pneumonia vaccine.
