Marine vet ICE agent sues Sig Sauer for $10M claiming pistol shot him on its own

Gunmaker Sig Sauer is facing a new lawsuit from a U.S. federal agent who claims his holstered P320 pistol discharged without him pulling the trigger and struck him in his upper right hip.

According to a Thursday press release by Saltz Mongeluzzi & Bendesky P.C., former U.S. Marine and Immigration Customs and Enforcement (ICE) agent Keith Slatowski was preparing to discharge his service pistol at a government firing range on Sept. 21, 2020, without him touching or even pulling the trigger.

The accidental discharge resulted in “substantial injury, maceration of tissue, blood loss, and nerve damage” according to the press release. The lawsuit alleges Slatowski’s injuries are the result of “potentially deadly design defects.”

The lawsuit is particularly noteworthy as the Sig Sauer P320 is a design nearly identical to the M17 and M18 Modular Handgun System adopted by the U.S. Army in 2017.

Slatowski’s lawsuit alleges the P320 has had at least 28 accidental discharge incidents among law enforcement officers, 15 of which have resulted in injuries.

It means it never happen. He pulled the trigger while drawing from the holster. He won’t be the first nor the last who’s shot themselves in the thigh trying to fast draw. I’m not even sure the firing pin has enough tension on it to even fire in the static position.

If there isn't video this is an exercise in futility.
He could have just as easily shot himself pulling the pistol out of the holster.

Anyone can pull the trigger while touching it. It takes a pro to pull the trigger without touching it. And only the truly elite veterans that are federal agents can discharge a handgun without doing either.

Remember the FBI agent (wasn't he from Denver?) that managed to discharge his service pistol without even being in physical contact with it while doing handsprings in a bar? That's the kind of training these folks get.

And given where he was hit, it sounds like he may have been carrying reverse Mexican at the range.

I know some folks that don’t care for the leather or leather/kydex combination holsters as the leather can weaken and perhaps allow for the trigger to get pressed.

Hard to believe Sig would allow such a defect. I’m more inclined to believe poor booger hook management.

Sig Sauer had a potentially lethal design flaw identified in 2017:

As if LEOs are all expert handlers of firearms. Remember the FBI instructor shooting himself in front of the class — inside a classroom? For one example.

Wonder if it was a serpa retention holster. Lots of instances among LEOs negligently firing those while drawing. You have to press a button on the side of the holster while you draw to release the gun. Often people keep pushing after the trigger guard clears the holster and end up pushing their finger right into the trigger and firing. Been a lot of shot toes that way. You’ve got to straighten that finger as soon as the gun clears the holster.

My husband is a stroke survivor and no longer has the strength to pull a trigger. I wonder if one of these self-firing guns would be right for him.

Knew an Austrian that played with his Glock and shot through the wall into the leg of the guy in the next room.

Negligent discharge. he was on way home next morning.
