Actually Abe Fortas was filibustered (would have been defeated had it gone to a floor vote, and then resigned even his associate justice post)...but that’s not an option any longer.

in all but one case when the senate was the same party, the nominee was confirmed. yhe one failylure was abe fortas.
in only ONE case tmdid a president of the opposinf party get a nominee confirmed, and that was a deal.
The thing about Kennedy was that he was the third nomination sent for confirmation.

for same party, 17 of 19. fortas the exception. one had to be held for constitutional reason to the 1st day of the next session.
for split party, 1 of 8 before election. 2 more after election, both deals made that mede it worth it.
point being, the 2016 move was in tradition, but with few examples.
but the idea that a party would reject their own president’s nominee? unheard of. only hspoened 1 out of 19, and that one got filibustered by a majority.
i think milkulski should be kicked out of the party. she ran as an independent agsinst a republican. she is not in a race, and wants to concede a pick by her own party.

washington nominated a guy who had worked on the creation of the court, and the constitution required that one election pass before he could be put on the court.
