Dead
The timing for Barrett doesn’t work.
If it were March ‘20, or March ‘21 ... a failed nomination just leads to a new name.
Save Barrett for Breyer
She’s young.
I was certain sold on her being much more of an actual conservative and a "originalist" than Gorsuch OR Kavanaugh. Hypthoetically, IF she ended up on SCOTUS, I think she'd be a solid judge.
But she wouldn't have been my choice (or made my "short list" for either of those seats, and certainly not for the current one), because she would be an easy target for the left to demonize, and paint her as a kooky religious zealot. If you thought they reduced Sarah Palin and Christine O'Donnell to a caricature, it will look like child's play next to the 24/7 hatchet job they'd do to Barrett. The "Keep Your Rosary Off My Ovaries" crowd would be out in force.
Again, easy target for the left to oppose, just like Merrick Garland (oh joy, another ivy league white liberal Jew) was hardly "confirmable"
And that is my gut feeling as well. I had several much better "originalist" options in mind for Trump's last two SCOTUS picks, where the situation was much more favorable (Trump simply replacing a GOP judge with another GOP judge in a non-election year, which wouldn't have changed the precious "balance" of the court). Sadly, he squandered BOTH opportunities, IMO.
I don't envy anyone in his administration now, I'd have a hell of time finding a "confirmable judge" in the current environment.
I'm 99% sure the RATS will vote in lockstep against ANY judge Trump picks before election day. They will also try to filibuster and/or prevent any such nomination from ever getting out of committee or reaching a floor vote, even if the filibuster is "officially" no longer allowed or whatever.
Then they just need 3-4 RINOs to join them in at least "delaying" the confirmation vote until January. If anyone thinks Susan Collins will jump at the chance to replace Darth Bader Ginsburg with an avowedly pro-life judge, I have a bridge to sell you.
IMO, the only way Trump could pick a judge that would be "acceptable" to the Senate RATS and the RINOs would be to name the judicial equivalent of Colin Powell... basically, some "Republican" that the mainstream media and lifelong card-carrying RATS all say they love and admire. And even in THAT scenario (which would likely mean we'd end up with a redux of Earl Warren and John Paul Stevens on the court...read up on their nominations, both were presented as lifelong "centrist" Republicans that the Democrats overwhelmingly liked and admired), I could see some RATS and RINOS still voting NO against the RINO judge, just because Trump is the one appointing him and they don't want to see Trump score a "victory" before election day and move the court to a "lopsided 6-3 GOP supermajority" on paper. Hell, I could see some RATS even voting against Merrick Garland is Trump dusted him off and gave HIM the seat like they say they want. Pretty much if Trump is for it, they're against it.
Again, I know my fellow FReepers don't want to hear it, but I don't see any judge getting confirmed before election day.

FYI. KATE TODD is 45.

I cannot find any video of Margaret Ryan.
Sykes makes a decent presentation.
Bade is 55.
If they go with someone that wins the PUBLIC RELATIONS battle, the Dems will pay a price on election day. For smearing her.
They have 51 votes ... hearings in Oct, vote in Nov.
We’re winning. Let the left self-destruct
I’m sure you read more posts than me but I didn’t see a single person claim Gorsuch “was the only confirmable nominee. People that liked the pick didn’t think he was “squishy”. YOU did, and you were right though I’d say it’s more that he has a “streak” of something, call it maverick stupidity if you will, that Indian territory decision was bonkers.
Collins is in a hard spot, if she votes no or actively kills the attempt, enough short-sighted conservatives will undervote the Senate race to ensure she’ll lose. She already pissed of her more liberal fans by voting for Kav, she made her choice. I will kick her in the vag if she tanks her reelection over this.
If we win the election it doesn’t matter if we fill it now. It might even be better to have the seat “open” to encourage our people to vote, it sure seemed to be a big help last time, Trump might have lost without it, but that was with the “balance” on the line. It’s on the line for the rats now but it’s likely this doesn’t motivate any rat that wasn’t already motivated.
But if we lose (and no I’m not certain of victory like some) then it becomes we HAVE to fill it before Biden/a rat Senate takes office.
Mark Kelly could be sworn in by Nov 30th if he wins. What would Collins do if she lost? Free to vote how she really wants without consequence, an eff you to the libs that voted her out? I wouldn’t bet on that. With Murkowski a likely (but maybe not certain no if she can bribed with some shit for Alaska) that could put us at 50 already for a lame duck attempt. Depending on Romney (possibly bribed with SOS by Biden?) not being a fag.
And if it’s a contested election, that 9th seat is important cause you can’t count on Roberts. A 4-4 tie would leave it in the hands of the appellate courts.
I say the smart play to bank this goddamn seat, asap. And I don’t really mind an 8 instead of 10 if the 8 is closer to a 10 on confirmabity. This is a replacement for 0. Breyer is likelier than not to die in the next term if Trump is reelected.
Unless someone can make the case it would be really GOOD for the election to NOT fill that seat now I think McConnell should get his thumb screws out, and his bags of bribe money and the kitchen sink.
Things are already happening OF COURSE. It started before she was cold, I’m calculating and heartless enough that hearing fake niceties about this witch from our side (what a ROCK STAR!!, maybe Ozzie Ozborne with full term fetuses playing the part of the birds) makes me roll my eyes at best. The libs know we don’t mean it just like we know they jizzed when Scalia died. Pantomiming is stupid.
But you can’t be “unseemly” by starting the official process for a little while. I’d have liked a special session LAST NIGHT with a vote and no hearings but that’s not the world we live in.
As for nominees
Larsen, I wanted her last time IIRC. She has a bunch of Hatian or crippled kids or something, that’s hard to attack but also makes me wonder about a bleeding heart under the surface.
Ann Coulter wants Miguel Estrada, she claims a Shcuemer staff memo is afraid of him because he’s Latino and has a slim paper trail, she also is extremely high on his qualifications. Hispanic might be a good idea. But he’s 58. Ideally we’d like 10 years younger than that. I agree with Coulter than gender is not a big deal here, it doesn’t “have” to be a woman, Biden made that mistake with his running mate, women don’t even like each other, the feminazis would have gotten over it.
Worth mentioning that Thomas Hardiman was the first runner-up for each of the previous nominations.

I don’t think there is a new list, he just added more names a few times.
As for Justice White, I respect him a lot for voting no on Roe despite being pro-choice. The constitution doesn’t say dick about abortion, end of story. Any other pro-choice anti roe people in the universe? People that like believe in “democracy”? Or is realpolitik too strong?
A shame he let Clinton replace him, he didn’t croak till 2002.
Bork said he was pro-choice .
Opposed Roe
Really? Fascinating.
Old is fine, as long as they retire during a GOP Administration.
The Souter scenario is the disaster. Give the seat to the Dems.
If you look at the senate calendar, there aren’t enough days before the election when the Senate is even there to confirm someone.
The key would be if Grahamnesty could vote someone out of his committee before the election. That might be the best of all worlds. It would force any squishes in the GOP to strongly support; it would turn out any small part of the base that was going to stay home (In AZ, Ward-ers or never Trumepers), but you could get the vote done before Kelly is sworn in if he wins).
I see no way the confirmation happens before the election, but I hope I’m wrong.
As for the mourning period, don’t be foolish. Even some of the staunchest GOP senators would find it repellent to move before that time. It would risk many of the squishy but likely-to-confirm justices like Alexander, Burrito, and Portman.
Lagoa. I think she presents herself well.
Has to help in FL election. Likely other Hispanic areas, too. Will it help McSally?
Father-in-law is a Clinton appointed judge from KY-FL.
Husband is also bilingual.

But the “Dem” he represented was dead by the time Watergate rolled around. That was an awful decision on his part.
I may be grasping at straws to find Lagoa’s liberal connection.
Paul Huck’s law firm:
Harley Tropin. Big donor to Sen. Nelson
Throckmorton. Is that his son who heads the LGBT group, “Equality Florida”?
Kozyak. A Dem, likely. Can’t find anything outrageous.

Tropin is a major bundler. Raised money for John Edwards.
Trial lawyer.
His 2 children are Dems. Relatives are Dems.
Was he really a sure vote on the 80’s court?
https://www.theguardian.com/news/2002/apr/18/guardianobituaries1
I didn’t claim he was perfect, only that he wasn’t the doctrinaire left-winger many expected him to be.
Has anyone parsed her concurrence from the Florida Felons voting case?
I never heard he was "personally pro-choice" but voted against Roe v. Wade anyway, are you sure? A ton of RINO and RAT politicians try the exact opposite tactic -- they claim to be "personally pro-life" and say they believe abortion is morally wrong and would never advise someone to get one, blah blah blah, but are voting to allow it anyway because they have no right "to force my PERSONAL beliefs on other people"
Fieldmarshaldj suggested it would be hilarious if someone got elected as a "personally pro-choice" candidate and swore up and down that they were fine and dandy with abortion on demand for any reason, but kept voting pro-life anyway with the excuse that "I have no right to force my pro-choice values on other people". I concur. Sadly, I've never seen any elected official (or judge for that matter) play that game. I'd love to give the RATS a taste of their own medicine and see how happy they are with avowedly "pro-choice" politicians who vote 100% pro-life.
As for Byron White, my understanding is his dissent against Roe v. Wade was based on his interpretation that the 14th amendment and the constitution's guarantee of right to life extended to the unborn as well as the born, so the court's decision ignored that the woman's unborn child had "rights" as well. That sounds to me as pro-life an argument as it gets. Ironically, I believe Rehnquist (the only other judge who voted against Roe v. Wade, it was a 7-2 decision) issued an extremely different dissent than had nothing to do with a pro-life argument. I think his reasoning for voting no was that the woman was petitioning the court to grant her the right to an abortion, but she had ALREADY given birth by the time the court heard the case, therefore he considered the issue null and void, and simply stated she had no standing before the court, and the entire "case" was a fabrication and thus should have been dismissed.
Byron White was overall a pretty decent guy and didn't just vote the "conservative" way on abortion, I believe he also had a conservative streak on issues like law and order, immigration, and affirmation action.
I'm surprised the "JFK was more conservative most of today's Republicans" crowd on FR don't cite the "He gave us Byron White" argument as more "proof" of JFK's alleged "conservative" record. I'm sure they could use it an example of all the "conservative" thinge he did, and ignore the fact that JFK's intent was to give us a LIBERAL judge, and he appointed White as a favor of the Labor Unions, and was greatly disappointed when White turned out to be more conservative than he was expected to be.
I am not sure, no. It’s just what I always heard (don’t ask me where lol).
Possibly his position is not even known?
