If the jogger was not there none of this would’ve happened like this either.
Even if it had been their house and things had been taken they couldn’t shoot him down the street (after he’s off the property).
It was a scuffle that was going to be deadly when the attacker continued to attack after it had discharged twice. If the jogger had obtained the weapon I don’t think he was going to cast it aside. If the rifleman’s objective always WAS to shoot (intended to murder him) it wouldn’t have taken 3 shots.
It may come down to whether they were brandishing a weapon.
I don’t catch where the call for charges against the videoographer are coming from. What is his crime? Conspiracy with the other 2 men? What about the neighbor who’d called the police about the break-in? Who told these men? Did one of them call it in? Some someone call all 3 of them? It isn’t illegal to pursue (at safe speed) someone and video it. Perhaps the charge is operating a cellphone camera while driving.
