Eric Holder didn’t think so regarding these two men who’d already lost their case for failure to appear (as I recall).
Two members of the New Black Panther Party, Minister King Samir Shabazz, and Jerry Jackson, stood in front of the entrance to the polling station in uniforms that have been described as military or paramilitary.[5][6] Minister King Samir Shabazz carried a billy club, and is reported to have pointed it at voters while both men shouted racial slurs,[7] including phrases such as “white devil” and “you’re about to be ruled by the black man, cracker.”[8]
The incident drew the attention of police, who around 10:00 am, sent King Samir away in part because of his billy club. Jackson was allowed to stay, in part because he was a certified poll watcher.[9] Stephen Robert Morse, a journalist and filmmaker, upon arriving at the scene, pulled out a Flip video camera and focused on Samir Shabazz.[10] The incident gained national attention after being uploaded to YouTube and quickly going viral. No complaints were filed by voters about the incident, although poll watchers witnessed some voters approach the polls and then turn away, apparently in response to the New Black Panther Party members.[11]
... In January 2009, less than two weeks before the Bush Administration left office, the Civil Rights Division of the Department of Justice filed a civil suit under the Voting Rights Act against four defendants, including Shabazz.[12][failed verification]
In April 2009 Bartle Bull, a former civil rights lawyer who was serving as a poll watcher at the polling station where the incident occurred, submitted an affidavit at the Department of Justice’s request supporting the lawsuit, stating that he considered it to have been the most severe instance of voter intimidation he had ever encountered.[7]
When none of the defendants who were charged appeared in court to answer the charges, the career attorneys pursuing the lawsuit assumed that they would win it by default. However the move to pursue a default judgment was overruled by two of their line superiors, Loretta King, who was acting Assistant Attorney General, and Steve Rosenbaum, Acting Deputy Assistant Attorney General.[5] The federal government dropped charges against all defendants except Shabazz in May 2009.[13]

If you pull your weapon out and point it you better have a good reason and it better be a direct threat to you or someone nearby and in imminent danger. That said, the Shabazz incident was intimidation and the outcome was a bit of a travesty.
Why didn’t they just shoot him as he approached the back of their truck of that was their game? You sure seem to think it was.

The first discharge is while they are scuffling in front of the truck (after the suspect ran around the vehicle).
There are 2 subsequent shots as they fight over control of the weapon.
What good is law enforcement? They are just a free ride to jail and have the judge set you free.

Have you seen law enforcement lately? They don’t go after criminals anymore. It just a civil crime. Call your insurance company.
Law enforcement only go after people/companies with MONEY! That’s the bottom line from their betters. No money in petty poor criminals.

To your #48 - if the shotgun was not there he would not have had his hands on it. And the “jogger” reference is only that - a reference. I know he was a criminal running away.
To your #49 - Why did he run around the truck? Did he see the shotgun in hand and was this a move due to a percieved threat?
I’ll say this again - the fact these men were lying in wait for the “jogger” looks very much like a vigilante hunt. The fact they had their guns “at the ready” shows they were ready for some violence. They could have and should have just followed him at a safe distance and communicated with law enforcement. These men were not threatened or robbed or attacked personally prior to putting themselves in harms way.
That’s the MO of criminals. They know you don’t want to ruin your life by shooting someone. That is why the criminal comes at you. They know.
I’m heading out for a beautiful Sunday pedal. Any more replies on this thread will have to wait. I’m not standing up for the jogger - he was clearly a criminal. I just can’t understand why these two dudes were handling this in such a manner - especially when one of the has LEO training.
The best that could have happened is they have to try to detain the guy (who could have legally just kept walking) while waiting for LE to show up. At best, the dead guy would have taken a ride to the station, then been let go, probably without posting bail, likely without even being booked.
Whats the worst that could happen? These guys have just found out.
