Corrupt attempt to Impeach!

Can President Trump petition the Supreme Court to expunge his unconstitutional impeachment?

The Constitution is whatever the Supreme Court says it is!

Democrats have been using it against us FOREVER!

Time to turn the tables, at least after Trump’s next confirmation.

The Impeachment by the House was a virtue signaling event from one Leftist to another. It was a media event. The SCOTUS cannot change that.

Although I agree with the sentiment, I must disagree with the Prof. In law terms he was charged but acquitted. The original charge is still on the record. In political terms he was impeached (charged) and acquitted. The charge is on the House and Senate historical record.The more significant takeaway is that he was politically charged in a strictly partisan manner by liberal House Democrats despite bipartisan support to not be charged. But the supporting “evidence” was defective, lacking due process, and rejected by the Senate. So yes, impeached with an astrick referring to and memorializing in American history the TDS in the House that overcame their sense of fair play and then wrongfully legitimized when accepted and taken up by the Senate despite glaring due process violations.

Short answer is no. The procedure is set in the Constitution.

Of course he can. It's a matter of finding a court that would give him standing (assuming he is acquitted) and give him the ruling he desires. I think it is doubtful SCOTUS would consider such a case.

The Constitution describes requirements for impeachment with specific words and phrases. Some of those being:

Article II Sec 4. "The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors."

This is easily (and rather obviously) interpreted as saying a President can NOT be impeached and removed just because the House and Senate do not like him. SCOTUS could reinforce that with a ruling that would serve as clear precedent.

Trump may feel that he has a responsibility to protect the office of the President from future frivolous, purely political impeachments.

Of course, there is a down side. What if Robert's SCOTUS takes the case and rules AGAINST Trump, setting a precedent that Congress CAN impeach and remove a President for any reason, even absent of a crime?

The larger point is that although PT was impeached (charged) he was impeached by partisans suffering from TDS and acquitted by the Senate. Historians and future attempts to impeach succeeding Presidents will, no doubt, recognize that Impeachment must become a more deliberative process that doesn’t run roughshod over the rights of the accused. Nancy Pelosi et al. will not be looked upon kindly by history...and she know’s it.

There was never an initial vote by the whole House to form an “impeachment” committee. The whole thing had no basis in the Constitution. Criminals.

Maybe you should read about the details of this illegal farce. Just watching TV doesn’t seem to do it for you.

The way Nancy, Adam, and Gerald are going he’s going to be the most impeached President in history. Let them keep trying. The Justice Department needs to pursue a boatload of corruption investigations/prosecutions.

Hopefully Schiff is indicted as a co-conspirator in the Buck investigation soon.

That’s true as they’re ready to go on to the next one the minute the vote for acquittal is finished in the Senate! They have a clipboard with many reasons listed and will check them off one at a time. They’ll be soliciting ideas from the populace!

And please can anyone tell me what Cipollone replied to Schiff’s statement yesterday on the floor of the Senate from Bolton’s book about him being in the room when the plans were made for pressuring Ukraine? I know that’s a tortured question but I didn’t get to see if he did REPLY and if he did, what it was. MSNBC had a ball with it last night - losing his law license etc. That was from all those law experts on that panel, you know!

Amazing that no one has even seen the book yet and may never see it, yet they have all the answers!

that’s not what you said.

There was vote in the full house on articles and they passed them. By definition, that’s impeachment.

If you don’t think he was impeached explain what they are doing in the senate. You can fantasize any scenario you want. I prefer to believe reality.
