Not Guilty! Self-defense: The Sergeant Stood Her Ground Woman with gun self defenseAnother California Stand Your Ground Victory. This week criminal defense attorney Joseph Tully successfully defended another self-defense Stand Your Ground client in California at the Contra Costa Courthouse in Martinez, just two blocks from the Tully Weiss office. This new case involved a African-American woman we will refer to as Sergeant Tara, an Army Veteran of four tours and an active reservist who used her personal side arm to defend herself against a deadly attack. Second: The DAs office has a duty not to show bias. I would suggest someone file a complaint with the State Bar of California.
“Epilogue:
The two robbers had a long criminal history. Despite that, and despite the fact they stole product from the store, assaulted Sgt. Tara, and tried to run her over, were NEVER charged with a crime.
The two arresting officers were rookies that had only a few months each experience on the force. The Assistant DA who insisted on prosecuting Sgt. Tara for defending her life, was not a rookie.”
I hope the store was able to sue the people who choose to rob the store even if the Ass. DA did not think that robbing a store was not a crime worth prosecuting.
” I would suggest someone file a complaint with the State Bar of California. “
How about an open letter to the D.A’s Office posted on the wall of every store in the town.
Totally acceptable!
I would suggest someone file a complaint with the State Bar of California.

When she had her nose in the CA Attorney General tent, Camel refused to punish or sanction DA’s and prosecutors using improper, probably illegal, methods.
I’m not sure but I think Cali decriminalized shoplifting. She’s lucky she wasn’t charged with attempted kidnapping when she tried to stop them.
Great job lady, and the best of luck to you in your future endeavors.
“ I think Cali decriminalized ”
Now I know I am getting old. California use to be such a nice state.
It’s a lawyer’s blog, drumming up business. Nothing wrong with that. But they use “Stand Your Ground” when they mean “Self Defense”. SYG has a specific legal meaning, and it is not a synonym for self defense. If a lawyer can’t comprehend that, I wouldn’t hire them.
No.
"Shes lucky she wasnt charged with attempted kidnapping when she tried to stop them."
She didn't forcibly detain them, until she had to defend herself.
My post about her being charged with kidnaping was sarcasm. As it was, she, not the criminals was charged and she had to go to the time and expense to defend herself in court.
You are right, shoplifting is still a crime in California. But the prosecutor has to prove you entered the store with the intent to steal. And it is, with some exceptions a misdemeanor.
From a Cal lawyer website:
In order to convict you of shoplifting, a prosecutor will have to prove that:
You entered an open commercial establishment during normal business hours,
You intended to steal merchandise worth $950 or less.
I wonder what it cost her.
