Executive Action: POTUS Donald Trump may be setting himself up for a huge constitutional battle if reports that hes preparing to issue an executive order ending birthright citizenship are accurate.

President Trump plans to sign an executive order that would remove the right to citizenship for babies of non-citizens and unauthorized immigrants born on U.S. soil, he said yesterday in an exclusive interview for Axios on HBO, a new four-part documentary news series debuting on HBO this Sunday at 6:30 p.m. ET/PT.
The order would be one of the most dramatic moves yet by the president as his immigration reform agenda continues to be thwarted by Democrats in Congress and far too many RINOs, though that could all change in less than two weeks of a legitimate red wave sweeps the midterm elections.

I’m pretty skeptical that an Exec order of this type will have any chance of being upheld in the courts.
After all the 14th amendment explicitly states that: “”All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States...”
He can do anything he wants. He’s the chief of police.

President Trump plans to sign an executive order that would remove the right to citizenship for babies of non-citizens and unauthorized immigrants born on U.S. soil, he said yesterday in an exclusive interview for Axios on HBO, a new four-part documentary news series debuting on HBO this Sunday at 6:30 p.m. ET/PT.
The order would be one of the most dramatic moves yet by the president as his immigration reform agenda continues to be thwarted by Democrats in Congress and far too many RINOs, though that could all change in less than two weeks of a legitimate red wave sweeps the midterm elections.
Still, there is little doubt the order would be challenged in court. For one, the Fourteenth Amendment states clearly than anyone born on U.S. soil automatically becomes an American citizen. Section 1 says:
All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
The amendment, passed in the aftermath of the Civil War, was aimed at conveying citizenship rights to newly freed black slaves. But in recent years, the Left has exploited the provision to encourage more illegal immigration from Central America and Mexico.
Pregnant women from south of the border who have their babies on American soil are instantly parents of a U.S. citizen, which makes them extremely difficult to deport.
In the Axios interview, the president said he has vetted the order through his legal counsel and is convinced that he has the authority as president to issue it.
It was always told to me that you needed a constitutional amendment. Guess what? You dont, POTUS said.
When told that he will likely face a swift and strong constitutional challenge, POTUS replied, You can definitely do it with an Act of Congress. But now theyre saying I can do it just with an executive order.
He continued: Were the only country in the world where a person comes in and has a baby, and the baby is essentially a citizen of the United States with all of those benefits, Trump continued. Its ridiculous. Its ridiculous. And it has to end.
Axios reported that 30 countries in the Western hemisphere have birthright citizenship, but nevertheless, the presidents right in that our system is being taken advantage of by the Left.
Some have argued that the 14th Amendment was only intended to provide citizenship to children born in the U.S. to lawful permanent residents not to unauthorized immigrants or those on temporary visas, Axios reported.
Thats the argument that POTUS Trumps administration is likely to make. Whether or not it will be successful remains to be seen.
Then again, it could that all of this is intended to bring the issue before the American people most are not aware of this constitutional provision or how its being abused so he can set up the real fight, which is repealing that part of the 14th through conventional means via Article V.
If he does it retroactively do we get to deport Obama?

Trump is persuading caravans to stop and turn around. Military, wire fences, tent cities, no jobs, no contact with families, and no birth right for future generations.
I think the real purpose of the EO is to smoke out the opposition, both Pubbie and ‘Rat.

Obama set the precedent that the president can do anything - even things he had personally said are not constitutional.
The question is if congress will stop him. After courts and congress had both told Obama he couldn’t do things he had done, congress just said “well, we tried to stop him”.
And, as an EO, a future D president will reverse it retroactively. But it will deter many women until then and stop some companies from offering trips to pregnant women with the promise of a US birth certificate.
The 14th should not apply to people in the U.S. illegally.

Trump is going for a two-fer: The EO will be blocked by a Federal Judge somewhere and Trump will take it to the SCOTUS asking that 1.) the EO be upheld, and 2.) that a ruling be made on whether Federal District Judges can block the Executive Branch on ANYTHING.
Remember, there was an attached opinion over the summer at the SC that said that the Court wanted to review the power of a single, unelected Judge to overrule the Executive Branch.
