A Chicago judge amazingly rules that grant money can be mandatory (Sanctuary cities vs Sessions)

The scrapping over JAG money (Justice Assistance Grants) for sanctuary cities reached the next level this week. A federal judge in Chicago somehow issued an injunction preventing the Justice Department from not issuing grant money to non-compliant cities. As the Associated Press reports, it was Chicago bringing the challenge, but the judge extended his ruling to cover the entire country.

A federal judge has ruled Attorney General Jeff Sessions cannot follow through with his threat to withhold public safety grant money to Chicago and other so-called sanctuary cities for refusing his order to impose tough immigration policies.

U.S. District Judge Harry Leinenweber on Friday granted Chicago’s request for a temporary “nationwide” injunction. That means the Justice Department can’t deny requests for the grant money until Chicago’s lawsuit against the agency is concluded. He wrote that Chicago has shown a “likelihood of success” in its arguments that Sessions overstepped his authority with the requirements.....

I wish there was a way to punish judges who make rulings like this knowing full well their decision is not within their power. This judge might as well rule that the sun must rise in the west.

Let me see if I have this right..........This judge is saying that the federal government has to follow through in helping illegal sanctuary cities continue in breaking the law of the land? I know he didn’t get his license to practice law from a Cracker Jack box...or did he?

So all those years where the federal government would withhold funds if you didn’t set the speed limit or drinking age to their liking we just a lie? Will the states now be free of federal extortion?

I respectfully disagree. The judge followed the constitution. I agree money should be withheld from sanctuary cities, but it cannot be done by executive fiat. That was one of our major beefs with Obama’s methods. Only Congress has final say on funding.

Only Congress has final say on funding.

I could be wrong -- not my area of expertise -- but I think Congress funds the Justice Depart, and (because Justice is part of the Executive branch) the Chief Executive determines how Justice will spend the money in its budget.

The judge thinks a jurist in Chicago determines how Justice will spend its money. I say he's wrong.

OK, they can’t deny it. Nothing to say they can’t delay it through normal paperwork. Make it the lowest priority for the DOJ to deal with, so it takes up to 2 years for the money to get through.

Trump can also use the courts to toss this tar baby, funding sanctuary cities, right back at Congress and encourage the voting public to hold Congress to account.

There is, it’s just never used. Congress can call that judge in to account for and be questioned by the judiciary committees.

They can impeach him, and the SCOTUS can reprimand them.

Scotus should put out guidelines on where and when Judges can go in questioning enumerated powers of another branch of Government.

Of this, this is my soul disappointment in Trump — is that he’s not enforcing his presidential rights and prerogatives in the face of this backlash. This weakens the Presidency which I feel shouldn’t be weakened.

Though he can’t just willy nilly ignore a federal court ruling, he certainly can when it’s obvious they are encroaching on executive territory. — and this will tend to weaken the Judicial branch of government so they’ll stop putting out these BS decisions.

Just all my opinion of course.

Money that was granted by executive fiat can be revoked by executive fiat. Prior to Trump, the executive branch would always win these types of cases. Now with stacked lower courts, we have to wait until they get higher, up the the Supreme court level even.

Have you noticed that the Progressives on the Supreme court have kinda buttoned up their lips. I’m sure Roberts reminded them that they were actually diminishing Judicial authority by antagonizing the Executive branch with side commentary.

This whole Federal/State issue recently went off the tracks when Sessions decided to be ‘nice guy’ and simply deny money to the political pols. I say criminals because all persons who harbor illegal aliens are criminals and need to be arrested and prosecuted. These brazen criminals are flipping their middle finger in the face of Federal authorities who have the Constitutional authority to determine immigration policy in this country. Of course, the root of the problem lies at the doorstep of corrupt Federal politicians who set the example of disregarding statutory law and actively encouraging and facilitating lawlessness. Just look at Obozo who illegally and contemptuously invited tens of thousands of illegal aliens into the country while he directed law enforcement to stand down. What do you expect the reaction to be from those observing that anarchy is trending.
