I can actually see having a part of the energy department remain - in charge of setting standards and enforcing them for nuclear power. This would be a sidebar under the defense/national security authorized area, as nuclear has potential immediate and long-term welfare of the nation consequences.

Thomas is 68. He’s got another 12-15 years on the bench. And you will never get someone confirmed as a rock solid constitutional as him. I’d rather stick with Thomas for 10-15 years then roll the dice on a Roberts, or worse, a Souter, who would give us 30 years of pain.

Yea, thanks. I agree...even as far as I went, we do need government to keep an eye on the nuke plants. I want the operators to understand that if they intentionally risk large nuclear spills, people will go to jail. Otherwise, require them to all get insurance for worst-case accidents...which then would quickly shut them down.
FR had a thread on this topic earlier this week; supposedly the inside dope was that after Gorsuch was approved, Kennedy was set to retire - but then changed his mind after the firing of Comey. The rationale being that the SC might need to join the impending fray (why he would feel the need to participate was unclear).

Mike Cernovich is reporting a twitter rumor that Kennedy will retire next week. But it seems to me he would want to be in on the travel ban decision.
“The Russians did it” will pale into insignificance when President Trump nominates a Conservative, in fact, from the moment Kennedy retires.
