Still Report #1074 – Russia Obligated to Return Emails by Treaty

This morning, Donald Trump asked Russia – or any other nation – who may have hacked Hillary Clinton’s illegal home server and acquired the 30,000 emails she destroyed in clear violation of the Federal Records Act – to please return them to the FBI for further investigation.

The Democrats – after having seen the LA Times/USC daily tracking poll – are going into panic mode. They twisted Trump’s words and got their mouthpieces in the MSM to do the same, claiming that Trump had really encouraged Russia to hack into Clinton’s server and get the emails. And then they claimed this constituted a treasonous act on the part of Trump.

Three small facts here. Fact #1: Hillary’s illegal servers no longer exist as working servers. They have been removed from Hillary’s basement and disassembled, the disks removed for deep forensic analysis in FBI Headquarters.

So Trump can’t encourage hacking something that does not exist!

Small Fact #2: What Trump really said in essence was; if you have the missing emails, please cough them up. He did not even courage hacking anyone, anywhere. This is yet another Clinton lie.

Small Fact #3: Russia is obligated by treaty to turn over the emails because whether or not they show any further wrongdoing – and you have to figure that they do – no matter what, they constitute 30,000 serious violations of the Federal Records Act of the United States.

Trump will either win or he won’t.

We’ve done what we can to give Americans a chance to save their country, whether or not they do is entirely up to them.

One thing I know for sure is that no one else in that pitiful field of GOP candidates, excluding Trump, had any chance at all of being elected president.

"...so,let me get this straight, if Russia has 30,000 hacked emails that Hilda destroyed and the FBI says never happen,....does this not prove Hilda broke the law by destroying evidence.....and wouldn't this evidence also show that there was classified material on her unprotected unsecured illegal server which is also a felony. So does Russia abide by the treaty in returning the emails piece by piece in lots of 2,000..*grins* publicly. Does popcorn mix well with sardines?<\p>

What makes the author believe that Hillary doesn’t/didn’t already have a NEW SERVER ready to use ?

Is she now sending her emails using the proper .gov servers ?

Article 1, Section 3: This Treaty is intended solely for cooperation and legal assistance between the Parties. The provisions of this Treaty shall not give rise to a right on the part of any other persons to obtain evidence, to have evidence excluded, or to impede the execution of a request.

In other words, this only applies to requests made by the official government, and not private individuals.

Article 3, Sections 1 & 2: 1. Each Party shall implement the provisions of this Treaty, including the making and receiving of requests, through its Central Authority.

2. For the United States of America, the Central Authority shall be the Attorney General or persons designated by the Attorney General. For the Russian Federation, the Central Authority shall be the Office of the Procurator General of the Russian Federation or persons designated by the Procurator General.

The request must be made by the Attorney General of the United States (Loretta Lynch).

Article 4, Section 1: The Central Authority of the Requested Party may deny legal assistance if:

(1) the request relates to a crime under military law that is not a crime under general criminal law;

(2) the execution of the request would prejudice the security or other essential interests of the Requested Party; or

(3) the request does not conform to the requirements of this Treaty.

Under Section 3, if the request is not made by Loretta Lynch, the Russians do not have to comply. That means any subpoena from any U. S. Court or any request from any person other than the Attorney General of the United States does not trigger the obligations of this Treaty unless attached to Ms. Lynch's written request pursuant to this Treaty.

Also, most importantly, under Section 2, the Russians can claim that production of materials they gained through the FSB or GRU "prejudices the security or essential interests of the Requested Party." Which I am sure they would claim. What country wants to disclose its intelligence assets and capabilities? Those are the very definition of "security or essential interests."

Article 4, Section 4: 4. If the Central Authority of the Requested Party denies legal assistance, it shall inform the Central Authority of the Requesting Party of the reasons for the denial.

Well, that is the interesting clause. If the Russians invoke Article 4 Section 1 (1) regarding security interests to decline any request, they will as much as admit that they have the e-mails, or some of them. Of course, they need not worry about this issue so long as Loretta Lynch is Attorney General of the United States, because she will never make that request. Nor will whoever is the AG under President Clinton.

Donald Trump's AG could make the request, but then I am pretty sure the Russians will invoke the security clause. They take their state secrets pretty seriously, and always have.

This takes the whole government down supposedly not just Hillary and Bill. Do you really think Trump gets elected???? That would require a fair election or no accident happening. I am not that optimistic.
