The GOP controlled Senate should gate itself on any consideration for Scalia's appointment to the DOJ indicting Hillary.
Hold off on the nominee hearings and re-issue subpoena's to those in the Obama administration over the IRS emails and DOJ emails and Benghazi.
Obama rescind all of his immigration executive orders that undermine the rule of law on immigration and naturalization.
Receive written public apologies from those Senators still alive and in elected office who borked Robert Bork and participated in the high tech lynching of Clarence Thomas.
Then and only then should the GOP consider a nominee. When all the grievances are properly settled rather than stonewalled and swept under the rug.

No, approving a Justice named by Obama should not be negotiable.
Obama’s failures to do all those things you mention are exactly why the Senate should not work with him on a Justice. He doesn’t exhibit good faith in allowing the Congress to do its oversight. And will continue to fail in the next 11 months.
Obama will not come clean on those scandals just to get a Justice named. Neither side trusts the other at this point, and justifiably so.

Already fired off notification to one of my senators to not hold any confirmation hearings. The other one is hairy screed so there’s no point in sending him anything.

As to judicial confirmation proceedings in general, perhaps add Miguel Estrada’s treatment by the dems to the list.
They should hold off until an autopsy and investigation are completed on the death of Judge Scalia.
A very bd idea.
First, no person should be either indicted or not indicted based on politics. We have seen too much of that already and it should be our goal to end it, not make it more political than it already is.
A person should be prosecuted only according to the facts of the case.
Second, some matters are reasonably settled by bargains....others should be settled only on their principles.
We should have the wisdom to distinguish between those that should be and those that never ever should be.
My dream is that the Republicans evade all discussion of the vacancy, answer no questions with anything but we’ll see about that, and take whatever minimal heat there is for being “obstructionist.” This situation is an existential threat to America. I don’t like comparing everything to the Nazi’s, but the analogy here is to Munich. Too bad Neville Chamberlain was not an obstructionist.

Ok. It makes logical sense.
Obama is not logical, however. IMHO Obama wouldn’t give an inch on the scandals. And the GOP shouldn’t trust him if he did move in that direction.
