Six Shooter Junction Once upon a time, some bikers decided to drink a beer at a bar by the freeway and catch up on the politics of handgun law as contemplated by the Texas Legislature.
Seemed like the thing to do, since both the U.S. and Texas Constitutions guarantee a freedom to freely express ones ideas in speech and writing, and to peacefully assemble with others with whome one may choose.
Now comes The State of Texas, by and through its Office of the Criminal District Attorney of McLennan County, and would humbly show unto WE THE PEOPLE that those laws do not apply when it comes to bombastic and hyperbolic charges filed on those who so choose.
None of those laws are even in the same league, much less the ball park, according to a response to a petition for an emergency writ of mandamus filed by an attorney who along with his client has been enjoined to keep his mouth shut about the facts of the case

In the wake of the violence, there was a heavy traffic of outlaw biker gang members traveling to the Waco area, and law enforcement intelligence had discovered that a green light had been given by certain criminal organizations to take retribution against law enforcement and/or members of rival gangs.

The States Response Brief (States Brief) actually highlights almost everything that is wrong with the gag order in this case. Indeed, it purports to give this Court facts of the case that it claims are facts because these facts are what [is] commonly known through press reports
.For example, despite the fact that Mr. Clendennen belongs to the Scimitars Motorcycle Club, the State cites its own repeated press conferences in order to allow it to repeatedly refer to these clubs as five outlaw biker gangs
Indeed, the word gang appears in the States brief ten times in an apparent attempt to prejudice this Court

More like a police ambush than a biker war. We still don’t know how many of the victims were shot by .223 rifles (police) as opposed to handguns (bikers). If any were shot by bikers at all. If the cops have nothing to hide they would release that along with videos of the “shootout”.

Yes, we want the truth...however it turns out. But the local Waco authorities are doing EVERYTHING THEY CAN TO HINDER/PREVENT the release of the truth that will be revealed by autopsy reports, videotapes, etc.
The one video that has gotten out “in the wild" (it didn't come from the State) was one that I'm sure the authorities thought would be innocuous. But a sharp eyed FReeper picked up that it showed an unarmed individual being shot and, much later, one of the authorities coming by the lifeless body and throwing “something” next to the body (a classic “throw down” weapon?). Between the intentional failure of the “State” to release any evidence and imposing of gag orders, things are not passing the smell test in Waco. We need some truth to “clear the air”...and we're not getting it. I wonder why that could be?

OTOH, the Texas Confederation of Clubs and Independents is run by the Bandidos.
The Bandidos moved the meeting to Waco after originally scheduling it for Austin.
The Cossacks were not members of the Confederation.
Cossacks sent out the word and and did a show of force by occupying the Bandidos reserved area before the Bandidos arrived.
Every witness that has stated a view has stated that the bikers started the shooting.

Not every parking lot fight will erupt into a police shoot down, and damned few witnesses are talking except those with a vested interest in covering their collective asses.
Most fights are adjudicated a hell of a lot faster, because everyone within a block (and farther) isn't summarily arrested. For those who are neither Bandidos nor Cossacks, and even those who are but have no priors, the punitve devastation of being held with $1,000,000.00 bail is designed to make them lose homes, jobs, and businesses.
The police and the federal gangs from down there are trying to run out the clock and wait until people forget.
Now, I still find it funny that the jail, built as a commercial venture with a history of excess vacancy just happened to have 177 openings for new inmates. Aside from not knowing who shot and killed/wounded whom, the potential haul of money from seized bikes, other vehicles, and personal property, the digging through cell phones wholesale, and identical charges brought against those who were there regardless of club affiliation, filling a jail that is a commercial venture, sequestration of evidence and possibly Brady Material, and waiting out the clock so as to be able to discredit witnesses based on time passed, the whole operation still smells worse than the head on a garbage scow.

So what do you think it was that he threw down...some MRE rations in cased the shot down individual arose from the dead or perhaps a book of bible verses?
