(video at link)transcript: Alex Wagner: Ambition aside there remains a question of constitutionality. Cruz was born in Calgary. That's in Canada to a mother who is an American citizen, so does he pass the natural born citizen qualification for president? Panelist Ben: Well the funny thing is the Obama Campaign last year did not want to make the case. You know, even if he was born in Kenya, we're fine (laughter) so this didn't really come up. But this is totally unsettled. George Romney, Mitt's father was born in Mexico...I think the general theory among lawyers is that if this came up the courts would fine a way to not rule on it. They would say that no one had standing to bring a lawsuit. Who would sue and say they had been harmed by this? What court would want to come anywhere near this? The theory is anybody the American people elect, they'll be fine. The courts will work around the natural born citizen thing, so all this craziness last year...forget it!
Gotta disagree with you on that. The State Dept.'s Foreign Affairs manual says such a citizen is NBC by statute and that statutory NBCs are not necessarily NBCs under the meaning of the Constitution and eligible to the presidency.
This country stinks to high heaven with lawyers in and out of political office and sitting (no thinking) on the bench and still somehow we are having a debate over if a man who first claimed himself to be Kenyan born when he ran for senate then a miracle of post birth occurred and his fetid fetus emerged in Hawaii.
The Founders did not write the Constitution in Vulcan and even if these alleged brilliant lawyers and judges can not agree on the language contained therein, the Federalist Papers are the Owner’s Manual for those too thick headed or, lets be truthful, so dishonest as to constantly obscure the meaning of our founding.
Even at the level of the Not So Supreme Court, we have black robed morons who pump out and endless stream of 5-4 decisions PROVING to any honest person that those decisions are 100% political and not founded in original intent. The only other explanation is their IQ is lower than an eggplant.
Curiously, MSNBC did NOT run video of Orly in their opening collage. Instead they had the cheek to run Sheriff Arpaio declaring Barry’s BC to be a forgery!
“The focus needs to be on the submission of a fraudulent document submitted as proof of eligibility, his birth certificate.”
Amazingly they ran a tape of Arpaio declaring the WH pdf to be a forgery...and then laughed that even if Barry was born in Kenya, the courts would find a way to ignore excuse it because he got elected.
All three branches being willing to ignore the Constitutional the READ constitutional crisis here.
“My eyeballing of it is that I would say yes to Cruz, no to Rubio”
Cruz, like Obama has at least one US citizen parent, the mother, while Rubio has ZERO US citizen parents and is, in effect, an “anchor baby.”
None of them meet the Minor v Happersett standard, but much water has gone under the legal dam since then...starting with only the citizenship of the married father passing to the child and women automatically gaining the citizenship of the US husband.
An interesting 5 minute discussion, now that Barry is safely reelected (they assume)...
We got away with kidnapping Lady Liberty, that means we can keep her.
Spin & more spin.
Keeps the media paychecks flowing.
So is it a) born in this country, regardless of parentage (14th Amendment coupled with citizen AT birth statement); b) born in this county and at least one citizen parent (a possible scenario for the current holder of office of POTUS); c) born on US controlled soil to 2 citizen parents (the McCain official story); d) born anywhere in the world to 2 US citizen parents (the immigration act of 1790 approach); e) born anywhere in the world to one US citizen parent (the Obama Kenya scenario) or f) “all children born in a country of parents who were its citizens” - the official RULING of the Supreme Court of the United states.
There are a lot of options out there!
Sure! It’s all good. They’re all born on earth, that’s what counts.
How does this indicate that they are natural born Citizens? Can I do that? Can you? That's how simple the issue is.
Failure of the SCOTUS to hear an appeal on the many cases that have reached it is a national disgrace.
Are you still interested in this issue? I’ve been doing research and I am finding all sort of interesting things.
Does anyone remember the circumstances of my being kicked out of the birther club? It began with my criticism of Orly Taitz.
Orly Taitz has her heart in the right place, but her methods and persona have been not been helpful. That she may have done more damage than good is a reasonable observation.
“To me it looks like the media may be trying to argue for Cruz being eligible. Why might they need to do this? IF the evidence that is going to come out in AL case shows that Obama was actually born outside of the US, then the media want’s the public to have the perception that it still doesn’t matter. ‘Hey... Ted Cruz is eligible, and so it Obama’.”
Sure looks like that to me. Them playing the tape of Arpaio declaring the BC to be a fake followed by saying Kenya birth OK shows they are concerned that Arpaio’s Posse is closing on the “person or persons” who forged the BC and whoever “knew or should have known” that it was forged (like Barry and Pelosi).
>>I’m trying to get an answer from one of those if Cruz is a US NBC, and a Canadian NBC? <<
That could be an interesting question!
The answer is, “Whomever has the wealthiest supporters willing to put their money behind him or her.”
I think she help by keeping the issue in the news. Not putting the best foot forward hurt her image.
“Im trying to get an answer from one of those if Cruz is a US NBC, and a Canadian NBC?”
Can we get a similar answer for Valerie Jarrett and Iran?
All five of these lefty "experts" on the MSNBC video are complete airheads, aside from being hypocritical with respect to Obama.
The truth of the matter is, from what we know, that Cruz is constitutionally ineligible (he fails both prongs of the NBC test: born outside the US and one parent not a citizen at the time of birth), that Rubio is constitutionally ineligible (he was born to non-citizen parents), and that Obama is constitutionally ineligible (he was born to one non-citizen parent, Barack Sr., and, for good measure, was likely born outside the USA).
We know from contemporaneous documents that the phrase "Natural Born Citizen" in the Constitution has a specific meaning, contrary to the nitwits at MSNBC, i.e., one born in on the soil of a nation to parents both of whom are citizens of that nation at the time of the birth. This is the definition of the term put forth by Vattel, with whose work the framers were familiar, decades before the writing of the Constitution. Furthermore, the US Supreme Court concurred with that definition in a dictum in its opinion for Minor v. Happersett.
BTW, I'm not taking anything away from Cruz or Rubio by saying that they are ineligible for the presidency. They are certainly constitutionally eligible for their Senate seats and are doing a good job there.
I'm not convinced that is true. Her level of incompetence is incongruous with the level of knowledge required to pass the California State Bar Exam. At first I thought it was a language barrier, but that would also be incongruous with the same.
We'll never know.
