Why Was Sarah Herlihy Worrying About Article II?
first published in 2008
Contrairimairi has forwarded a post from Insight Analytical concerning Sarah Herlihy's article that was also discussed in the blog Count us Out. Someone had forwarded Herlihy's article to me and I blogged it on November 29. Herlihy works for the law firm of Kirkland and Ellis out of their Chicago office. The kicker is that Herlihy's article was published in the Kent Law review in 2006 and, notes Count us Out Blogger Creative Ogre:
"While digging my way through the Internet last night, I came across the following paper, written by SARAH P. HERLIHY. Its title: AMENDING THE NATURAL BORN CITIZEN REQUIREMENT: GLOBALIZATION AS THE IMPETUS AND THE OBSTACLE caught my eye, and had to read it
"I had to ask myself, what would drive any American to want to change a clause in a document that is the very foundation of our government? So, I kept digging, and found that SARAH P. HERLIHY is employed by Kirkland & Ellis LLP
"Noting that this law firm is based in Chicago, the light bulb was shining a little brighter . Upon looking at the firm, and the partners, I found that Bruce I. Ettelson, P.C., is Member of finance committees of U.S. Senators Barack Obama and Richard Durbin.
"In addition, Jack S. Levin, P.C., another partner who, in December 2002 was presented the Illinois Venture Capital As sociations lifetime achievement award for service to the private equity/venture capital community presented by Sen. Barack Obama
"So it sure looks like Obamas people have looked into the matter of Natural born as far back as early 2006. What is even more disturbing is that it would appear that they are following the thought of "If the facts do not support the theory, Destroy the facts!
Here is the introduction to the paper
It looks like a road map for Obamas defense lawyers
And a precursor to a Socialist world."
Looks like the article has been scrubbed???...LINKS not working? Contact Sarah and ask for a copy! LOL

It shows that nobody now claiming that this is a clear and indisputable fact had any inkling of it before Obama was elected.
You're amazing! You're able to follow people around the Internet wherever they go whenever they went! I mean, you seem to know that nobody went to another site and discussed it there or talked about it in an e-mail or even discussed it via FReeper mail.
Amazing! Simply amazing.

So even though every new birther theory gets aired instantly across multiple threads, this particular one just happened to be shared through private correspondences until after Obama was elected. Oh yes, that makes total sense.

("...nobody went to another site and discussed it there...")
That just doesn't fit the meme you're trying to set, does it.
It was kind of like the few brave individuals who started talking about the North American Union here on FR who were roundly criticized and ridiculed. It worked wonders. Nobody wants to postulate anything outside of the norm any more. And now several years down the line vindication comes as Wikileaks showed.
Yeah, you just keep pushing your wagon. (cart before the horse)

I see you don't address it being discussed outside of FR. Again, are you suggesting that people were discussing it on other sites, but not Free Republic, where every other birther theory got aired, even the most outlandish?
I can search the web based on specific dates, and I'm not seeing anyone talking about this until late in 2008. Not here, not anywhere.
Unlike the private emails, this should be easy to prove; all you have to do is post the sites you're talking about.

So since you can't nobody else can?

Jeez...you just have to push that meme, don't you. Very well, here are a couple of sites which is more than you're worth. I suggest you brush up on your search skills.

Notice that the scribd.com date of the very first response is Feb 22, 2006. You don't realize what a shitstorm Sarah Herlihy's article caused when she released it on 2/22/2006 @ 4:49:09 PM, do you!

Here's a clue for your dumb ass...natural born citizen 2006 Have you completely forgotten what we were talking about, or are you purposefully trying to change the subject? I was specifically talking about the theory that natural born citizen means two citizen parents.

Amusingly, your links only reinforce my argument that nobody was talking about the Vattel definition of natural born citizen at the time.

I guess you didn't read any of the comments.
Do I need to take you by the hand and point them out directly too?

The only remotely relevant thing you posted was a single blog post, and even then, the comments don’t agree with that position until late 2008, which is when I said this discussion began.

Well now you're getting specific. That may take a while longer to find.

I think I see where our newly self-appointed monitor is going. If no one was discussing Vattel prior to a date certain then Vattel must be ignored. It’s like the speed limit in my town. The driver’s ed book the highway and safety department hands out for taking the TN driver’s license exam states that unless posted, the speed limit in town is 30mph; barry the bastard’s defenders read that as unless a speed limit is posted, there is no speed limit, especially if you’re not caught doing 80 mph through town.

I had to change what I was looking under...
But I get the impression that she believes only children born to two citizen parents should be granted birthright citizenship. June 5, 2006
Which led to this...
What makes an American?
Clearly, the custom of granting automatic citizenship at birth to children of tourists and temporary workers such as Hamdi and to countless "anchor babies" delivered by illegal aliens on American soil, undermines the integrity of citizenship not to mention national security. Originally intended to ensure the citizenship rights of newly freed slaves and their families after the Civil War, the citizenship clause has evolved into a magnet for alien lawbreakers and a shield for terrorist infiltrators and enemy combatants.
If the courts refuse to close the birthright citizenship loopholes, Congress must. Citizenship is too precious to squander on accidental Americans in Name Only.

From Feudalism to Consent : Rethinking Birthright Citizenship March 30, 20
06Drawing on an impressive array of legal scholars, from Vattel to Blackstone, Justice Fuller correctly noted that there was a distinction between the two sorts of allegiance-"the one, natural and perpetual; the other, local and temporary."[20]That means you have to seek out
Fuller's dissent.
Before the Revolution, the view of the publicists had been thus put by Vattel:
The natives, or natural-born citizens, are those born in the country of parents who are citizens. As the society cannot exist and perpetuate itself otherwise than by the children of the citizens, those children naturally follow the condition of their fathers, and succeed to all their rights.Vattel was being discussed, only under the aspects of anchor babies, not presidential eligibility, even though it applies to that issue as well.
Do you want some more? I can keep digging.

It's easy enough to see how the discussion of one subject (anchor babies) would eventually migrate to the other (presidential eligibility).
You grok that?

Grok is a seldom used word, but a good word—use it myself now and then...
