On Friday, Manuel Osorio-Arellanes was arraigned in a Tucson federal courtroom for second-degree murder, conspiracy to assault a federal officer and firearms possession charges in connection to the December shooting death of U.S. Border Patrol Agent Brian Terry
Though others have also been charged in Agent Terry’s death, the Justice Department has sealed their names.
Osorio-Arellanes is scheduled to go on trial on June 17, if convicted, the Mexican national faces up to life in prison.
On December 14, 2010, Agent Brian Terry was shot to death in the Arizona desert, while patrolling one of the region's most dangerous drug and human smuggling corridors. He was actually looking for Mexican bandits who typically prey on those crossing into this country illegally.

We should be pushing for a federal death penalty for any foreigner who harms an American, whether it be for murder, attempted murder, rape or molestation of children.

Holder will insist he be tried in Federal Court and then provide him with a lawyer smarter than the fed prosecutor (not a difficult task), thereby guarantying him to get a not guilty. He will then be given US citizenship for his trouble.
Life solitary confinement, 18 hours of electro chemical induced pain and a daily beating by a lottery chosen American.
I would much prefer that for him rather than an easy way out through a painless death penalty.

I saw no reference as to the weapon that killed BPA Terry, was facilitated and supplied to the narco perp by Holder, his DOJ and ATF minions. Those bastards should have also been standing before the judge for murder.
They should be sealed up in a wall guarding the border.

As with current US-Mexican policy, if he was extradited from Mexico, the US has a policy of removing the death penalty from cases of this type prior to Mexico relinquishing custody. I’ve had two cases where both the State and the Fed’s had to provide written motions to the courts removing any death penalty sanction prior to Mexico extraditing the suspect.
