Alabama high school band director is TASERED by cops in front of screaming students and arrested for refusing to stop the music after football game ended

The director of an Alabama high school's band was tasered by police in front of horrified students and arrested after he allegedly refused to stop playing after a football game ended.

Johnny Mims, leader of the band at Minor High School in Adamsville, was charged with disorderly conduct, harassment and resisting arrest for encouraging the students to keep playing after the game at the Jackson-Olin High School had concluded on Thursday.

The band had continued to play as police were trying to clear out the stadium following a win by the Minors.

Both the teams band kept playing after the game was over, but the losing team quickly left after police asked, according to police.

Shocking footage shows the moment police tasered Mims as teens scream in the background. The department said in a statement: 'During the officers' interaction with Minor’s band director, the decision was made to place him in custody.

'BPD officers attempted to take the band director into custody for Disorderly Conduct when a physical altercation ensued between the band director, Birmingham City Schools personnel, and BDP officers.

Mims was taken to the hospital, as is protocol after a taser is used, before being booked in a Birmingham jail.

He has since been released on bail, as reported by The Washington Post.

Following backlash, Jefferson County School Superintendent Walter Gonsoulin said on Friday he's gathering facts and urged 'everyone not to jump to conclusions.'

Mims, who has worked at the high school since 2018, appears to be a beloved member of the community, and many have come out to support him and denounce the incident.

“Too many police are trained to believe that whatever they say is a “lawful order or direction” but that isn’t correct. “

Exactly right. And making up their own laws as they go rather than acting on how a law is actually and legally codified.

Like arresting folks for drunk driving when they are riding a horse or driving a wagon. The law specifically states “While operating a MOTORIZED vehicle.”

Do they actually not understand the definition included in the statute that states exactly what constitutes a legal motorized vehicle? Or do they think they can create legislation and change legal definitions on the fly as needed because they are above the law as legislated and codified?.

why were they being told to disperse?

Ask the cops. Even peaceable assembly sometimes requires a permit.

The Constitution doesn’t say the cops can’t tell you not to shit in the streets, either, so I guess that’s all good.

You are the one saying that they disobeyed a lawful order. I just would like to hear what it is. And so now bands needs a PERMIT to play after the game? Interesting. I would like to read the text of the law. Please link.

The Constitution doesn’t say the cops can’t tell you not to shit in the streets, either, so I guess that’s all good.

Actually does fall under the Tenth Amendment. If your locality does not have a law against it then you are correct. They can not tell you not to drop a load.

However there is an amendment about peaceable assembly and none about the right of the people to poop in the streets shall not be infringed.

I was mainly screwing around.
In the real world, you know there are state laws, local laws, and what happens when you break them.
I understand the online intellectual discussion, but there’s also the pragmatic reality.
There is likely more to the story, but we are not likely to know.

Maybe it was a noise restriction (time based). I don’t know about your town’s high school football stadium, or the one in the story, but ours is right in a residential neighborhood. Sure, you have to expect noise from the game, but when it’s over, knock it off.

Yes but I am not screwing around. I would like to know why the police felt free to torture someone for playing music in public in a place where they had the right to be.

I know stupid laws exist so I just would like to read this one.

Then you can just list that law for me.

You are the one calling it a lawful order so I would like to see some evidence.

” But you have yet to provide a law that was broken.

Not one that you imagine.”

Exactly right. They can’t just make up laws and statutes as they go along to support their sadistic fetish for unfettered authority...

I was once arrested “For being a smart ass”. I ask him for the statute. They held me in jail for three days and then the DA “dropped charges” and cut me loose just before I was to be arraigned.

What charges were there to drop? They wouldn’t tell me. They never even mirandize me the whole three days I was there...

I can search. My guess is non compliance of a lawful order.

Maybe subsection 6? I’m not a cop...

“Maybe it was a noise restriction”

And maybe it was “let us finish this last number” and the cop said “no... Right now because I said so or I am going to tase you!”.

Nowdays my theory is absolutely much more likely. Ever watch “Cops”?

This is impatience and lack of compromise and “I said right now! is standard authoritarian protocol.

I feel ya. My dad has dementia too. I’m thankful for the good ones but yes cops these days are to be avoided if at all possible because many of them are hostile and lack judgement. In fact, in all walks of life people just aren’t the same anymore. :(

The police were just doing their jobs, following standard procedure. There is no record of any policeman violating any citizen’s rights.

Yeah...I liked watching “COPS”

What I see is a video that starts about 14 seconds before the tasing...we join in progress:

'During the officers' interaction with Minor’s band director, the decision was made to place him in custody. 'BPD officers attempted to take the band director into custody for Disorderly Conduct when a physical altercation ensued between the band director, Birmingham City Schools personnel, and BDP officers.

That’s the trouble with these short videos. We’re shown a media bite, and some journalist’s slant on it. That’s what preceded the Rodney King and George Floyd hysteria that gripped the country in their respective times.

We clearly are not a nation of people that can police themselves, as the anarchists/Antifa/ BLM/ Defund the police crowd would have us believe. And we’re getting to the point where policing forces are drawn from a smaller pool of people willing to do the job. There will be conflict.

Without getting into the conspiracy theories of TPTB driving us via Cloward-Piven tactics into an anarcho-tyrannical state, what I believe we are witnessing is the foretold “fundamental changing of America.” It’s going to get worse.

This country has gone over the edge.

America was founded as a Christian nation. It was a Christian nation till the 60s. That's when we began expelling Christ and in His place, started worshipping according to humanism.

Today's America is what happens when each human is his own god. We have no foundation and acknowledge no absolutes.

The 60s told us, "It's Your Thing. Do What You Want To Do" and "If It Feels Good, Do It."

Yeah, you've come a long way, baby. /sarc
