Retired California roofer, 57, who fled moving United plane through emergency exit and walked along its wing after staff refused to serve him alcohol

Randy Frank Davila, 57, has been pictured for the first time in a mugshot obtained by DailyMail.com. He has been contacted for further comment about his alleged antics.

Chicago Police have also revealed that despite the chaos Davila allegedly caused, he'll only be charged with a misdemeanor reckless conduct.

That is because neither the exit window nor the tarmac displayed signs warning that it would be a felony offense to exit a moving plane and trespass in a restricted area.

The drama began on United Airlines flight 2478 from San Diego to Chicago O'Hare Thursday after it landed in Illinois and began to taxi towards its gate.

Davila is accused of 'pulling the emergency exit window while taxing, walking out on the wing of the plane, then sliding off the wing of the plane and attempting to direct the plane into the gate,' the police report said. He has a $3,000 recognizance bond.

The Chicago Police Department reported he was 'denied alcohol service by the flight attendants' and was 'talking to himself throughout the flight.'

However, Davila will not be charged with a federal crime due to there being 'no signage on the emergency door nor the tarmac advising the subject that exiting a moving plane would constitute criminal trespass to restricted areas.'

Passengers aboard United Airlines flight 2478 from San Diego were stunned when Davila ripped open the emergency door in row 21, where he was seated, around 4.30am on Thursday.

“attempting to direct the plane into the gate

Now, who would even know what is, let alone try it?”

- Hey, Larry, where’s the forklift?

- Forklift? It’s over there by the baggage loader.

- Look out!

Flight Aware lists the jet in this case as a Boeing 737-900. Can a person just “slide off the wing” and start directing traffic? Hell yes, if the bones and nuscles are loose enough!

Funny Story to follow and it is real as this man was my friend.

He had been in the Saudi Desert for a long time working on the drilling rigs. No alcohol there unfortunately. He was flying back to London and proceeded to get drunk, understood. The air hostess told him he should have no more alcohol. He told her that she had the choice of an obnoxious drunk if she gave no more alcohol or a very pleasant drunk if she continued to serve alcohol. He arrived at Heath row in London drunk and pleasant.

In the old days we were told ignorance was no excuse of the law. Now there has to be signs?

So if, mid-flight, I pull out a ball-peen hammer and smash an airplane window, I can be charged at most with vandalism, and be compelled to pay the cost of replacing the window.

Unless there's a sign there saying, "Do not smash this window mid-flight!"

Check!

Regards,

Sometimes, if a dude just needs a drink, just give him the damn drink.

And this is one of the reasons why I try to get a window exit seat aside from more leg room.

“Hey, who’s messing with the Wing Exit !?”

“Probably just a bad safety switch, we’re almost to the gate.”
