Hawai'i election official's sworn affadavit: 
"No Obama birth certificate exists"


ALL Americans who support our nation's Constitution and election laws must now ask: WHERE IS IT? As the Obama birth certificate controversy drags-on, any unbiased observer could tell you that events are strengthening the birthers' case by the day... not the other way around.

Oczam's razor theory dictates that if they can't find it... there must not be one. This would also provide the most viable explanation for why Obama has spent almost $2M fighting the claims in court. And to since it's a principle requirement for presidential eligibility... would someone please tell me WHY the burden of proof is on us

How'd this guy even get a passport without a long-form birth certificate, anyway...

"During the course of my employment," Adams swears in the affidavit (viewable in full as part 1 and part 2), "I became aware that many requests were being made to the City and County of Honolulu Elections Division, the Hawaii Office of Elections, and the Hawaii Department of Health from around the country to obtain a copy of then-Senator Barack Obama's long-form, hospital-generated birth certificate." 

As he inquired about the birth certificate, he says, his supervisors told him that the records were not on file at the Hawaii Department of Health. "Senior officers in the City and County of Honolulu Elections Division told me on multiple occasions that no Hawaii long-form, hospital-generated birth certificate existed for Senator Obama in the Hawaii Department of Health," Adams' affidavit reads, "and there was no record that any such document had ever been on file in the Hawaii Department of Health or any other branch or department of the Hawaii government."

Tim Adams, former senior elections clerk for Honolulu In a recorded telephone interview, Adams told WND that it was common knowledge among election officials where he worked that no long-form, hospital-generated birth certificate could be found at the Hawaii Department of Health. "My supervisor came and told me, 'Of course, there's no birth certificate. What? You stupid,'" Adams said. "She usually spoke well, but in saying this she reverted to a Hawaiian dialect. I really didn't know how to respond to that. She said it and just walked off. She was quite a powerful lady." 

Moreover, Adams was told that neither Queens Memorial Hospital nor Kapi'olani Medical Center had any records of Obama's birth at their medical facilities: "Senior officers in the City and County of Honolulu Elections Division further told me on multiple occasions that Hawaii State government officials had made inquires about Sen. Obama's birth records to officials at Queens Medical Center and Kapi'olani Medical Center in Honolulu and that neither hospital had any record of Senator Obama having been born there, even though Governor Abercrombie is now asserting and various Hawaii government officials continue to assert Barack Obama Jr. was born at Kapi'olani Medical Center on Aug. 4, 1961." 

"We called the two hospitals in Honolulu: Queens and Kapi'olani," Adams stressed. "Neither of them have any records that Barack Obama was born there."


The debate has been recently been amplified by Hawaii's weird hippy Governor Neil Abercrombie -a far-Left freak who was previously a member of the US House Progressive Caucus and a personal friend and college classmate of both of Obama's parents. Abercrombie  made an ill-advised claim during his 2010 gubernatorial campaign that he would soon put a rest to all this, stating he was on a  "mission" to "quell" the birthers- as the polemic has "implications for 2012 that we simply cannot have."

But there is no Obama birth certificate... there never was.  So now he's hiding behind Hawaii's state AG, who says there is a privacy law that prohibits Abercrombie from doing as he promised (unless Obama gave him permission, of course):

State Attorney General David Louie told the governor that privacy laws bar him from disclosing an individual’s birth documentation without the person’s consent, Abercrombie spokeswoman Donalyn Dela Cruz said Friday.

“There is nothing more that Gov. Abercrombie can do within the law to produce a document,” said Dela Cruz. 

“Unfortunately, there are conspirators who will continue to question the citizenship of our president.” 

Conspirators! That's rich- but condescension and slander coming from nervous Dems does little to re-assure thinking persons that this man is acutally qualified to be US President: on the contrary, this defensive, diversionary behavior speaks volumes. Clearly those propping up this Trojan Horse of a president have nothing left but mocking the inquisitors- but as Margaret Thatcher once said: "... if they attack one personally, it means they have not a single political argument left." And indeed they do not-


Delving a little farther back, Obama even admitted himself that he wasn't qualified for the presidency in the 2004 Keyes-Obama Senate campaign debate, but the video of this was scrubbed from YouTube, according to Good Ole Boy at RealAmericanPolitics

Keyes caught him off guard... and Obama spilled:

I watched the entire first and second debates.  I distinctly remember that I had never heard of Obama; my interest was in seeing what Keyes said about the pro-life issue and school vouchers.

At one point in the second debate, Keyes, accused Obama saying, “You are not even a natural born citizen!”
To which Obama immediately replied, “So what? I am running for Illinois Senator, not the presidency.”

At the end of the airing of the second debate, the C-Span host noted, as he read from a single sheet of paper, placed before him, that the Obama Campaign had contacted them and requested them to point out to their viewers that Obama’s response here should not be understood as a denial that he is a natural born citizen, only that Keyes’ accusation had nothing to do with the qualifications of office of a U.S. Senator...

Today... with even Chris Matthews saying "why not just put it out?"- I unapologetically throw my hat in with the birthers... time to cough it up or step-down, Barry. Even is some obscure court ruling keeps Obama in office... this man must not be allowed to run for re-election in 2012. 

And when the day comes when we remove this tumor from the neck of the American eagle... Obama and his accomplices must be punished harshly for not just violation of oath, but the myriad crimes committed in covering-up lack of qualification for US president, up to and including perjury. And that means the entire Obama campaign team, lawyers, and most of the DNC... you're all going to pay dearly for this one.

Get on the stick, GOP congressman... 
where's the subpoenas?

It has been apparent for some time; I believe the anonymous former employee who released copies of the documents in the Hawaii records file through the midwest lawyer two years ago is credible; there is no long form birth certificate to be had or found in Hawaii. He wasn't born there in August of 1961--and a birth file was established in the name of Barrack H. Obama II on August 8, 1961 without a birth certificate.

Do you know how the BO campaign got America to believe the birth certificate image was for real, legally? ...Political advertising!

The ‘Fight the Smears’ web page with the image of a birth document is a political advertisement and conforms with U.S. Code 441.d, Publication and distribution of statements and solicitations. This code section deals with campaign funding, reporting and other parameters but does not require the material to be truthful by the person advertising. Political advertising is legal even if the advertiser does not tell the truth. In Edenfield v. Fane (91-1594), 507 U.S. 761 (1993), the Supreme Court said this in regard to the First Amendment right to freedom of speech and advertising;

“But the general rule is that the speaker and the audience, not the government, assess the value of the information presented.”

The campaign threw up an eye-catching wizardry of a political advertisement displaying graphics for visual impression, displaying statements of impression such as ‘native born’ and the candidate’s status as a ‘citizen by the 14th Amendment’ and solicitations of impressions to ‘donate now’ and tell others, all for the truth about the candidate.

The state of Hawaii has not ever stated that the online image was issued by them as the ‘issuing authority’ of a genuine ‘identification document’. The political ad by the campaign did not provide any further information verifying that the image came from the Hawaii Department of Health, Vital Records. The original online newspaper and fact checking organizations (L.A. Times, Daily Kos, Annenberg Political FactCheck, Politifact) who received the image from the campaign said they received the image from the campaign.

So therefore, the online image of the birth document means nothing...

...except that many many Americans were duped into believing the image was for real including our own state and national public officials!

He says: No there isn't. The two terms are synonymous.

There you have the entire Natural Born Citizen argument.

Now enter the "Birthers," who rightly point out that Obama has not proven Hawaiian Birth. We cannot prove that he was foreign born. He cannot prove that he is Hawaiian born.

Which brings us back to the fundamental importance of Article II, and the question, "Can a dual citizen be a Natural Born Citizen?"

Yes. Doesn't that have to be the rule? Otherwise, we cede control over our own candidates to the laws of other countries.

Look, the eligibility of someone to be President must be based on our laws, not on the laws of another nation. Otherwise, you give other nations a veto power over who can run for President. Suppose Palin wins the nomination, and Iran passes a law declaring her an Iranian citizen. That makes her a dual citizen, and hence....ineligible?

The most you could do is make a so-called "dual citizen" ineligible if, under the citizenship laws of the U.S., that person could also be considered a citizen of another country. But you just can't have a "no dual citizen" law, or other nations will have a field day messing with us.

No one, repeat, no one, prior to the Fall of 2008, claimed that natural born status required two citizen parents. Period.

Why did no know bring up the two-citizen parent requirement when Spiro Agnew was a vice presidential candidate? Or better yet, Michael Dukakis? Both men had at least one non-citizen parent.

Or better yet, how come not a single person raised the issue until AFTER Obama was elected? It was both well-known that he was running AND that his father wasn't a citizen. And yet, no one thought that might be a problem until after he was elected.

Sorry, ladies. Your story just doesn't pass the smell test.

The two citizen parent argument was discussed in the public arena in the Summer of 2008 (that's prior to the Fall) regarding Barry. Further, the two citizen parent argument was discussed in the public arena in the Spring of 2008 with regards to McCain.

All one has to due, is Google: two citizen parents "natural born citizen" between the dates of Jan 1, 2008–Aug 24, 2008 [the day prior to the DNC nomination] gives (according to Google) "About 21,900 results" with many familiar sites listed. [Edit: Now the results are 21,500]

FURTHERMORE...the two citizen parent definition was reiterated by many in government over the years. For example:

John Bingham, "father" of the 14th Amendment, the abolitionist congressman from Ohio who prosecuted Lincoln's assassins, REAFFIRMED the definition known to the framers by reiterating Vattel's definition...not once, but TWICE during Congressional discussions of Citizenship pertaining to the upcoming 14th Amendment!

Vattel's definition for "natural born citizen" was read into the Congressional Record during the Civil War.

"All from other lands, who by the terms of [congressional] laws and a compliance with their provisions become naturalized, are adopted citizens of the United States; all other persons born within the Republic, of parents owing allegiance to no other sovereignty, are natural born citizens. Gentleman can find no exception to this statement touching natural-born citizens except what is said in the Constitution relating to Indians." (Cong. Globe, 37th, 2nd Sess., 1639 (1862)).

 

Vattel's definition for "natural born citizen" was read into the Congressional Record after the Civil War.

every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen.” (Cong. Globe, 39th, 1st Sess., 1291 (1866))"

No Congressman offered up a counter argument, EITHER TIME, to Congressman Bingham's reiterating the two citizen parent definition for Natural Born Citizen. They ALL knew what it meant.

The same definition was referenced in the dicta of many early SCOTUS cases as well...some examples:

"THE VENUS, 12 U.S. (8 Cranch) 253, 289 (1814) (A case on citizenship and domicile. Marshall, C.J. concurring) (cites Vattel six (6) times by name, and "law of nations" ten (10) times.)
"Vattel, who, though not very full to this point, is more explicit and more satisfactory on it than any other whose work has fallen into my hands, says
"The citizens are the members of the civil society; bound to this society by certain duties, and subject to its authority, they equally participate in its advantages. The natives or indigenes are those born in the country of parents who are citizens. Society not being able to subsist and to perpetuate itself but by the children of the citizens, those children naturally follow the condition of their fathers, and succeed to all their rights.""

We now know that Chet was ineligible. But that wasn't that well known in 2008, only being definitely established last year by Lawyer Donofrio's research.

I am sure that Team Obama researched the Arthur case very thoroughly before they decided to try and end-run Article II. We have lived through an anti-constitutional coup. I fear that all that is left to us in the short term is damage control.

Ironically, the Constitution Team Obama violated now protects him!

I suggest you take the time to go back and research the FR threads leading up to the election if it is really that important to you.

Another Freeper, LorenC, has already done that. He found not a single example of a thread dating from before the election making the argument. I checked his work and found it to be accurate.

I am certain it was discussed here before the fall of 2008.

I'm afraid your memory is failing you, my dear, because it simply wasn't.

I don’t remember exactly when Berg and Donofrio first filed their lawsuits but I beleive think at least one of them may have been filed before September 2008

That would be Berg, whose lawsuit is solely based on Obama's birth place and does not make the two-citizen-parent argument.

Your scenario explains Barak Obama’s 1971 Christmas visit.

I believe that the Dunhams paid off Barak Obama to adopt/re-adopt Barry back. That it was necvessary to reorganize Barry’s “paperwork.”

There is absolutely no other explanation for Barak’s visit.


Now, here’s the mystery. Why would Senior fly halfway across the world to make his only visit to his son at this moment in time? Remember, this was in the era before the deregulation of the airlines. Round-trip airplane tickets from Kenya to Hawaii must have cost a small fortune even by American standards — much less third-world Kenyan standards. The Dunhams surely paid for the airline tickets. We know they paid for an apartment in their building for the month that Senior was in town, and were undoubtedly providing him with some walking-around money.

!!!!!!!!!!!!!The sad truth is Senior spent most of his time partying with with his old snack bar buddies from the University of Hawaii, Neil Abercrombie and Pake Zane.!!!!!!!!!!!!!!

How about those the social events ol’ Neil recalls the happy family attending?
