WASHINGTON — The Supreme Court on Tuesday allowed Title 42 — a Trump-era immigration policy implemented when the pandemic broke out to quickly expel asylum-seekers at the border — to remain in effect for now, putting a judge’s ruling that would have ended it last week on hold. The court voted 5-4 to grant an emergency request by 19 Republican state attorneys general who sought to intervene in defense of the policy. The decision puts on hold a ruling by Washington-based U.S. District Judge Emmet Sullivan, who said the Centers for Disease Control and Prevention’s implementation of the policy was...

Former White House national security adviser Michael Flynn on Wednesday demanded in a new court filing that Judge Emmett Sullivan recuse himself from "further participation" in his case, citing an "appearance of bias," which his legal team cast as "terrifying and mandates disqualification." In a filing on Wednesday, Flynn and his legal team argued that Sullivan “cast an intolerable cloud of partiality over his subsequent judicial conduct” and “risked undermining the public’s confidence in the judicial process.” “[A]ll that must be demonstrated to compel recusal,’ then, is ‘a showing of an appearance of bias …sufficient to permit the average citizen...

A federal judge late Wednesday halted all proceedings in the case against President Trump’s first national security adviser Michael Flynn. U.S. District Judge Emmett Sullivan issued a one-page order hours after a federal appeals court ordered him to dismiss the case saying he overstepped his authority by keeping it alive. The move buys Judge Sullivan some time while he decides whether to appeal the 2-1 decision by the U.S. Court of Appeals for the D.C. Circuit. Judge Sullivan could appeal the case to the en banc appellate court or the U.S. Supreme Court. It is also possible one of the...

Whitaker describes this as the “obstruction of justice trap.” Essentially, this approach confirms the second-prong purpose of the Mueller investigation itself. First, use the special counsel in 2017, 2018 and into the beginning of 2019, as a shield (hide information); and secondly a weapon (threats) against any entity who would reveal the background intelligence that undercut the Trump-Russia collusion narrative. We know President Trump was threatened by Rod Rosenstein not to declassify any information in September of 2018 or the Mueller investigation would use that act as evidence of obstruction. Whitaker confirms that same approach was applied toward any executive...

Before becoming a judge, Gleeson was an Assistant United States Attorney for the Eastern District of New York. In that capacity, he worked closely with Andrew Weissman, perhaps the most hardcore Trump hater on Robert Mueller’s defunct team of Trump haters. Sullivan plainly has it in for Michael Flynn. In addition, I gather, he wants to show William Barr who’s the boss. I believe the Constitution makes Barr the boss when it comes to deciding whom the United States will prosecute and for how long. The imperial Judge Sullivan can’t seem to accept this reality. It may fall to a...

The Justice Department’s move to dismiss the prosecution of former national security adviser Michael Flynn does not need to be the end of the case — and it shouldn’t be. The Justice Department has made conflicting statements to the federal judge overseeing the case, Emmet G. Sullivan. He has the authority, the tools and the obligation to assess the credibility of the department’s stated reasons for abruptly reversing course. The department’s motion to dismiss the Flynn case is actually just a request — one that requires “leave of the court” before it is effective. The executive branch has unreviewable authority...

Ex-National Security Adviser Michael Flynn’s war with the government isn’t over just yet. He scored a decisive win, with the Department of Justice filing a motion to dismiss the bogus “lying to the FBI” charges against him. Charges that were politically motivated, part of an elaborate and expansive FBI plot to entrap the former top Trump official. James Comey and Andrew McCabe were out to get Flynn no matter the cost. Department policy and the Constitution be damned; they were going to him. Flynn was the target of the FBI’s counterintelligence probe into Russian collusion because he spoke with the...

Now the purpose of the leaked conference call, aka instructions, from former President Barack Obama come into play. In a very unusual move today Michael Flynn’s judge, Emmet Sullivan, enters an order granting outside parties the time to enter amicus briefs (friend of the court) to assist in guiding the court; a briefing schedule to follow. …”Given the posture of the case the court anticipates individuals and organizations will seek leave to file amicus briefs” … It looks like the judge wants to give former DOJ employees (2,000 signatures on letter) an opportunity to publicly undermine and undercut the position...

US District Judge Emmett G. Sullivan unquestionably knows that when a federal defendant pleads guilty but then asks to be relieved of his fate, it is up to the court to decide the merit of his argument — no matter who supports it, including a prosecutor who has switched sides. Sullivan is presiding over the case in which former National Security Adviser Michael Flynn pleaded guilty twice to serious federal crimes and is ready for sentencing. The fly in the ointment is a recent request by Attorney General William Barr that basically says: Never mind. Ignore those guilty pleas; Flynn...

In an order released moments ago, Federal Judge Emmet Sullivan has denied all of the Brady requests by the Flynn defense lawyer and summarily rejected the position of defense counsel. Flynn sentencing is scheduled for January 28th, 2020. Judge Sullivan relies heavily on the Mueller report and finds: the case was adequately predicated and authorized by Rod Rosenstein; the original guilty plea to Judge Contreras was appropriately informed; the government followed all appropriate notifications for brady material; the evidence of Flynn’s guilt is accurately demonstrable to the guilty plea Mr. Flynn accepted; and there was no prosecutorial misconduct.

After a flurry of court filings and blockbuster developments last month, the Michael Flynn criminal case has been dormant for nearly three weeks. The parties and the public now await word from presiding Judge Emmett Sullivan on the pending motion to compel and motion for sanctions filed by Sidney Powell, the lead attorney who took over FlynnÂ’s case shortly after the special counsel team disbanded.PowellÂ’s motion seeks to force federal prosecutors to provide Flynn an array of documents withheld from his attorneys and to sanction government lawyers for their failure to provide relevant evidence to the defense team in...

As many of you know by now, my team is being sued for seeking the truth in the unsolved murder of Seth Conrad Rich. The former data director of new voter registration for the Democrats. Something that we haven’t talked a lot about is the fact that anything found in the discovery phase (discovery goes both ways, and we have nothing to hide) has been sneakily put under a sealed order. What that really means you might ask? That means that whatever we find in our discovery as a defense (bank records, emails, eBay records, PayPal records, phone records, autopsy),...

Emmet Sullivan has always been a no-nonsense judge. He was no-nonsense in the late 1980s when, in his capacity as a D.C. Superior Court judge, he presided over a case I was handling. He didn’t preside long. Instead, he tossed the case on our motion for summary judgment. His opinion was brief, to the point, and affirmed unanimously by the D.C. court of appeals. Judge Sullivan was no-nonsense in his treatment of the prosecutors in the case of Sen. Ted Stevens. He took the extraordinary step of dismissing the ethics conviction of Stevens and naming a special prosecutor to investigate...

A federal judge on Thursday ordered that the videotape of Hillary Clinton’s former chief of staff giving a deposition later this week be sealed so it can’t be used in political attacks against the former secretary of state and likely Democratic presidential nominee. Judge Emmett G. Sullivan said the transcript will be made public, so the public will know what Cheryl Mills says. He said it was “unnecessary” to have the video released. He extended that order to all of the depositions being taken in the open-records case, which also applies to Mrs. Clinton’s closest personal aide, Huma Abedin. Neither...
