What does the “letter of the law” even say, presuming we can hold our noses and look at what’s happened to the constitution in the process (there shouldn’t even BE this kind of sugar being handed out).
Does the covering legislation allow enough vagueness, enough wiggle room? That’s again a problem with the modern model, however. Different courts have different ideas about what’s enough.
Drain the swamp. Don’t try to filter its water in place.
I heard Eric Erickson say this was a good thing because the repubs can use the same federal issue against the dems... that using federal funds to force states to do something should not be done.
One problem with that thinking.... first, the dems would not be bothered by this.. they do what they want and the media protects their lawlessness. Second, the republicans would not do squat against the dems. Helpless and spineless against the party that has no limits to their lawless deeds.
With that scenario, the conservatives lose... the United States lose.

Head count based subsidies is a major reason why sanctuaries became sanctuaries. It was, to them, another way to add head count. And earlier USSC’s ruled that we couldn’t “discriminate” in favor of US citizens.
I think Trump is going to try to arrive there through a process of letting the faulty things fail and shining a public light upon it.

When the immigration ban EO was blocked by the lib Seattle judge, at the same time a different judge in Boston ruled that the EO could stand. I don’t understand why Trump followed the bad ruling. Why didn’t he just go with the other one?

People have a way of wanting its errors or “errors” corrected through morality.
And they actually have a point. Legalities without morality can drill us deep, deep into a hell on earth.
However where do we get the morality? It used to be that it was pretty simple, even if there was disagreement about details. Bible morality would carry the day when there was a question.
But now we’re philosophizing ourselves in a dozen contradictory directions.
