Biker attorney seeks to replace judges, demands immediate release of clients
Waco Tribune ^ | 5/26/15 | TOMMY WITHERSPOON

An attorney for two men arrested in the May 17 Twin Peaks shootout between rival bikers says his clients are being held illegally and is seeking to replace all McLennan County judges connected to the case.

Austin attorney Adam Reposa alleges in motions filed Tuesday that the charging documents filed against his clients, and the 168 others jailed in the chaotic melee, are legally insufficient.

He also claims that the $1 million bonds are unreasonably oppressive and that the judge who set them and the judges who, so far, have not reduced them have shown bias and should be recused.

Reposa represents Jimmy Pond and Thomas Paul Landers. He said Pond, a mechanic from Hays County, is the sole supporter of his family, which includes a disabled wife and autistic son.

Besides the recusal motion, Reposa filed an application for writ of habeas corpus, alleging a client is being held illegally and without proper cause, and a motion for emergency release so Pond can go home and take care of his family.

After the shootout, in which nine were killed and 18 wounded, Reposa said officials “commandeered” the Waco Convention Center as a makeshift holding area while they tried to sort out the magnitude of the event.

“How old did you say you were?”

I think he said he is 68. I am 67.

He posts most of the content here, and backs up his opinions and interpretations with sound reasoning and facts.

And he doesn’t attack others.

Facts.

And does not attack.

And he's 68...

Okay...I got it. I'm clear.

Are you his spokesman?

Just asking......

ALL of them.

The vast majority of bikers are vets.

And that includes all “percents”.

What is your obsession with that, anyway?

Are you desperately trying to foment some kind of “Nazi” meme?

The Sowilo predates Nazis by thousands of years and they perverted an perfectly innocent thing, as usual.

It is often used by people with Nordic ancestry or those who identify with Norse religions/mythology.

Really? So this and the previous three other Waco threads were all aberrations? What are these facts and reasoning you speak of?

115 gangsters that have records as clean as a whistle.

Absence of a criminal record is really not relavant to the rules on snitching that outlaw MCs operate under...as all the folks arrested are quite aware.

One of those gangsters is a retired police detective...

Another meaningless data point...surely you're not going to argue there aren't any dirty cops in the world are you?

Quit believing the Waco police lies about who was there. It has been completely discredited.

No idea what you're referring to here...care to elaborate?

Head and center mass shots only.

Looks like snipers attacked before the storm troopers kicked in the doors.

Typical police state MO.

So what they murdered a bunch of low life bikers. They probably have smoked marijuana at some time and deserve to be slaughtered. Toss a few grenades in the baby's crib just because they know they can get away with it.

Nazis and they don't even know it.

“Nazis and they don’t even know it.”

National Socialism is the reigning political dogma of our time, even though almost everybody is opposed to it, at least on paper.

The fetishization of “active” government and its oily doings is a key feature of this.

Only a not-so-latent Nazi could be proud of being an ATF employee, for instance. Decent humans would recoil in disgust from such a career.

In the meantime, the police want 170 million in bail money

Correction...its the courts not the police which determine the bail amounts and gets to keep the money if the arrested person skips out.

Yes

115 of the 170 hardened criminal bikers Spokesman Stanton was referring to are so good at crime they have never been arrested in any state. In other words the police lied about the 170 people they have arrested.

One of the 170 is a retired 32 year veteran police detective of the San Antonio police dept. He had been driving a school bus in retirement ( a job that requires an extensive background check and spotless driving record). If you want to believe he was a bad cop and a hardened criminal biker go ahead but I would suggest doing more homework.

One of the men killed was a 65 year old Vietnam vet, purple heart recipient. His family has stated he was not currently part of any biker gang and was non violent. Associated press could find no prior arrest record for this victim which further substantiates the families statements.

Police have made numerous statements that have already been proven false. These are just some of the examples.

We have also had many members of law enforcement and those in the justice system from outside of Waco stating something is clearly wrong with the events in Waco and both the police and the courts are acting in a manner not consistent in any way with proper legal process.

You have your opinion and I have mine but I can tell you very soon light is going to shine down on what really happened in Waco. I think we will find there were some bad actors present but they were very few in numbers and most being held are completely innocent of any crimes. They have been violated by the Texas courts holding them on bail amounts that are clearly unconstitutional and unwarranted by any stretch of legal president in this state. The coroner has already stated four of the deceased were likely killed by law enforcement. The fact that nothing else has been released on the topic of forensics does not bode well for the police narrative on the incident.

"“115 of those arrested showing no convictions on their records.” Aren’t you equally as skeptical of that, as you are of other items you seen posted on the internet? "

No I'm really not skeptical of this at all as it's too easily verified by anyone. AP is not going to distort something that is public information, easily verified by anyone that wants to take the time to do it. So no, I'm sure that is correct. What's worse is that the police have even easier access to this information yet Waco police spokesman Stanton made public statements that all those being held are known criminal bikers. He definitely knew that was a patently false statement.

You have to use logic when deciding what's believable and what's not.
