Should Parental authority be terminated (for both parents) when they divorce?
In a forty page bill, sponsored by the Louisiana State Law Institute - effort led by retired family law professor Spaht.
The law is difficult to read to see what has changed because she is erasing all of the existing law and rewriting and reorganizing it. So all the text is marked as new, even the parts that are existing.
This is long standing law that has not been revised in decades.
Of all rhe bad parts of the bill, the one change I am highlighting is this.
Under our current laws, parental authority terminates when a child becomes an adult (age if maturity ie 18) or when a child is emancipated (freed early by a judge).
This bill, in article 235 proposes to add the clause that parental authority also terminates when the parents divorce.
The bill is already out of the Senate committee (tuesday), read for the second time (wed) and was initially up for final vote Thursday. That vote was put off tuntil this coming monday.
Can we get some smart freepers to weigh in?
There is a lot of limiting of parental authority and demoting parents in this proposed law.
In many places the word 'parents' is being removed and replaced with the vague term 'any person with parental authority'...
So who is that?

I agree that when children are involved, “divorcing” should be the last resort-—and made difficult, as before the fraudulent “no-fault” divorce (Lenin’s construct), which made the contract of marriage a joke intentionally.
The goal of the Left is to undermine the Roles and Natural Instincts of children-—to destroy the terms “mother” and “father”, and make them meaningless, like they do all other words. They want a Brave New World where children are free from the tyranny of parents and copulating in the fields. The elites will be giddy with glee in their basement corners or in the fields with the kiddies.....like Epstein, Clinton and Dershowitz??????.......and probably Justice Roberts (He is being bribed with something evil).
They want ignorant, sex-addicted useful idiots-—and that is what “Sex Ed” is designed to create-—destroy Natural sexual identity formation and warp their desires and fixate them on sex. Sex Ed is a Cultural Marxist (Lukacs) invention and did not exist until the Neo-Freudian junk was forced into curricula in the 60s. By 70s, they had Sex Ed in younger and younger years-—so they could totally warp the innocence of children which is essential during Latency for intellectual and moral formation (and NO warping).
“Homosexual” “marriage” is to destroy the concept of biological connections in children——to make it Good and destroy Christianity (pillar of Western Civ). They will progress to have NO parents eventually-—like with the above action, so the State can corrupt and destroy the minds of the children and create cogs in the wheel (happy slaves).
Eliminating biological connections-—and their goal is to destroy all biological connections (much like “The Giver”)——to dehumanize children, remove them from the only humanizing element in life-—biological connections which creates the ability to love, trust, connect (and be interested in) the future, the past, etc.
It took Christianity centuries to eliminate the idea that polygamy, pederasty and slavery was “Good” in 3rd World countries——like it took over a thousand years to shape the pagan cultures of Europe.
In two generation the Marxists have pumped out such a multitude of ignorant, dumb children, who are so sexually warped and morally bankrupt, also because of immoral, neglecting parents who are too lazy to control the TV or make kids eat with them-—we may be doomed already.
With TV/MOVIES/Public schools all saturating children’s minds with filth and normalizing evil-—it is only a matter of time before we collapse and are all slaves of the State.
We need to kick the government OUT of the family and OUT of public schools and throw out the boob tube. Think of how the mind of Lincoln was formed——zombies sit in front of the TV-—it rots the brain-—shuts it down. Make your kids read the Great Books. Their heros will be Ben Franklin—his auto-biography is awesome for children-—and they will idolize the brilliant men like Washington and Jefferson and Adam Smith. Lincoln idolized William Wilberforce, not “superman” or “iron man”......teach children the Truth, our History, and the greatest, most brilliant and rational religion (Christianity) in the history of mankind. Make them THINK. Give them the FOUNDATION so their minds CAN THINK.

The evil socialist John Dewey threw it out-—but thank goodness it took many decades for all the local schools to follow suit—because unlike Europe (which was doomed), we had a Republican form of government (for a while).

By the time they propose something, the skids are pretty well greased for easy passage unless there is serious opposition.

However, the digest of her bill disagrees with her... :)
As does I suspect the United States Supreme Court that has repeatedly ruled that parenting is a fundamental right that cannot be interfered with by the State except for good cause.
Typically, a parents rights are not terminated unless they are unfit in some way THAT IS HARMFUL TO THEIR CHILD.
It sounds seriously dangerous for families to me. But so does divorce.
More “progress” in taking children away from parents and handing over control to the government.
This should be fought at every step of the way. The government already has far, far too much interference in parenting.

The federal gov becomes non relevant. It has been this for a long time. The American people have allot to catch up on.
Spaht wrote, campaigned for, and was the main force behind Louisiana’s Covenant Marriage law. Her social conservative credentials are bonafide, but I’m not sure what this bill is trying to accomplish.
True, she did do that - covenant marriage. However, last time I looked, usage was less than 1%.
She is also in charge of Jindals Marriage commision.
I do not know that I would agree that she is a conservative.
She also led the 2001 legislative task force that gutted the Dss/Da child support proposals of 2000. Her bill sponsor for that legislation was Jackie Clarkson and the far left.
A Conservative does not delete the word ‘parents’ from a parental authoruty bill and replace it with ‘a person with parental authority’.
Why is that?
Louisiana is a no-fault divorce State. Although it is better termed a unilateral divorce state. Only one paety has to head for the door.
