Sgt. Bowe Bergdahl, the U.S. soldier who was recovered in Afghanistan last spring after five years in captivity, faces charges of desertion and misbehavior before the enemy, according to his lawyer.

And so did Sec Army McHugh and the new Sec Def.
Are there any “Active Military” guys that are prepared to stand against 0bama ?
I mean Generals etc..
It may come to this before too long.
Good.
You are correct that the President can pardon anyone for any crime except treason, and there is nothing to prevent it. However, I am not sure if he can pardon someone for crimes they have not been charged with. For example, I don't know if he could pardon Hillary for any crimes she may have committed during his presidency that might be discovered at a later date...
Possibly, but remember bh0 has his pen and phone and doesn’t actually care about the law or the constitution.
Daddy and mamma Bergdahl are both into the conspiracy over their heads. Loss of US citizenship and any associated benefits should be a minimum penalty. To have Obama feeling you up is certainly not ‘American’. Just goes to show that there are politically and practicing he-whores and she-whores. As to Obama he was born and raised by such.
Actually, I just looked, and the President can even pardon treason. It was argued during the Constitutional Convention that treason should be exempted from the pardon power, but that proposal was defeated. The only thing a President cannot do with the pardon power is interfere with an impeachment.
Also, the Presidential pardon power is limited to offenses against the United States. So the president could not pardon or commute the sentences of all non-violent drug offenders, for example (as some have worried). He could only do so for those convicted for federal drug offenses, not state offenses.
I'm sure they meant to say "traded for five Taliban generals who combined aren't one-tenth of any of the brave soldiers who died trying to find the traitor".
Summary judgment. Good men died trying to find this POS.
Because some are saying he has mental issues and was “captive” for five years that any sentencing will be light if at all. However he will loose some of the benefits he has and may loose his military pay.
If he is recommended for court martial and found guilt under either Art 85 and/or Art 99, he will be reduced to E-1, forfeit all pay and allowances (to include his back pay for the last 5 years that he has not yet been given), be given a dishonorable discharged and imprisoned for 5 years (Art 85) or life (Art 99).
It may be possible if not recommended for court martial that he might be charge with being AWOL and then given a less than honorable discharge. I’m not sure what rank, benefits/pay would result.
I seem to remember that there was a large monetary amount paid as well as the five terrorists freed for the Bergdahl exchange.
Am I incorrect?
Thanks
He’ll be pardoned.
What I found interesting, the Pentagon was the last to know.....just wow! Why was Ft. Bragg making the announcement? Also, Col. King arrived exactly at 15:30, not an hour later like the POTUS. Col. King is a respectful leader, the latter, not so much.
Sign me up. I would gladly volunteer to shoot this bastard.
Post COs are something like gods on earth with sweeping powers including the imposition of sentences in military convictions.
US Army Forces Command (FORSCOM), which is in charge of the Army’s combat forces is headquartered at Ft. Bragg, NC. It was at Ft. McPherson, GA until 3 years ago when McPherson was closed. MG Dahl, Deputy CG of I Corps at Ft. Lewis, WA, is the investigating officer and I Corps is under FORSCOM
The “Pentagon” did know about this announcement and it would not have been made without the permission of the Secretary of Defense and the Secretary of the Army. Because Bergdahl was in a combat unit when he went AWOL/deserted, having FORSCOM do the announcement kept it in the combat arms and Bergdahl’s original unit is under FORSCOM when it is at its stateside home station.
Something tells me that the administration that let Manning do his transgender stuff in prison is not going to go too rough on a deserter..
He’ll get a pardon from the _resident.
