Fox just said he deserted because he saw a anti-Islam video that upset him.....which if so was likely the reason he decided to do what he'd been planning all along....which was to join their side!

I'm hoping that whatever they stick him with that it might be that which a Presidential Pardon couldn't touch...Don't know if that's possible though.

Under the misbehavior before the enemy charge, Bergdahl faces a maximum punishment of confinement for life, a dishonorable discharge, a reduction to private and total forfeiture of pay and allowances since the time of his disappearance, Army officials said. The desertion charge carries a maximum punishment of five years in prison, a dishonorable discharge, a reduction to private and a total forfeiture of pay and allowances.

Charges should be brought against Obama for releasing 5 "terrorist detainees" in exchange for this dirt-bag loser.

Definitely a step in considering OBAMA'S accountability and state of mind, as well as Bergdahl's.

Should Obama grant Bird-dog a Presidential Pardon...do the families of those who’s sons died or were maimed searching for him have any recourse to press charges?

I ask this because a Presidential Pardon is a “Federal” pardon.....so would they have recourse??????

Do we even know who’s in the Jirga?

I tried to find out June 2014, but couldn't. Abdullah Abdullah, and a couple others out of Kabul (Pashtun), that I could ID, but that's it.

Omar will probably be there one day after the Paki Taliban (and ISS) have their way.

My memory says that, like in a civilian court, it has to be a jury of his peers, so there must be at least one enlisted member on the court martial. I think that can be satisfied by appointing any level enlisted member to include a sergeant major. Memory also says it does not have to be unanimous except if the death penalty is imposed.

Unfortunately the President can pardon anyone he likes. He can even pardon Hillary Clinton for any crimes she may have committed while serving as Secretary of State, so that she doesn’t have criminal charges hanging over her head during the 2016 presidential campaign.

2. I agree with you and hopefully our fellow Freepers will realize that.

#1 — I am sure that there was tremendous political pressure for either MG Dahl to not bring any charges or for Sec Army McHugh to quash any announcement/report that would bring doubt on President 0bama in declaring him a hero and to have served with honor.

#2 — There were many derogatory comments on how the Army would whitewash the entire Bergdahl affair and not bring him up for any type of charges that would lead to court martial.
