Democrats lost the Senate, but so what? President Obama still has two more years and a veto.
But there is at least one area where the GOPs new Senate majority makes a big difference: a Supreme Court nomination. While its still unclear whether Obama will get to nominate another justice, the Republican gains in November make it unlikely a liberal nominee, such as Justice Thurgood Marshall, would be confirmed. And a nominee like the two Obama-appointed justices currently sitting on the court, Elena Kagan and Sonia Sotomayor, would face a possible filibuster.
Only a true middle-of-the-road nominee such as Justice Stephen Breyer before his nomination hearing or a perfectly qualified, center-left nominee such as Justice Ruth Bader Ginsburg would be a favorite to be confirmed.
We know this thanks to research spearheaded by Lee Epstein, a professor at Washington University in St. Louis, which measured what matters in gaining Senate confirmation. As I noted in September, ideology has become the single biggest factor the ideology both of the nominee and of the senators. Qualifications are now a secondary consideration.1 They still matter (see Harriet Miers), but even the most qualified candidate picked from an ideological pole would face a slew of opposition.

1st repeal the 17th amendment! As long as zombies can vote for state senators (rather than legislature, which it’s supposed to be) it’ll be a kangaroo court all around.
You would have a huge statelessness problem if you dont consider a child born abroad a U.S. citizen.
She has a point, as babies born of parents from nations that have only citizenship based on jus soli would indeed be stateless.
“How do you figure? Filibusters have been done away with when it comes to judicial nominees. And McCain, Graham, Collins, and Kirk will vote to confirm anyone Obama nominates. Your only hope at this point is to pray, and pray hard, that Ginsburg doesn’t retire any time in the next two years.”
I really dont see there being much chance at redemption in a Federal injustice system that has proven it self so capable of rewriting law as whim. Until there are effective checks upon their tyrannical power it is unreasonable to expect any juged could be appoited that would be able to resist such a temptation to corruption.
The federal injustice system needs to be abolished for the most part and its more corrupt injustices put on trial for dilibearly disregarding thier oath.
What remains needs to be left to the States and what their people pass as justice systems. The Federal courts only ever had remotely legitimate jurisdiction on disputes between them and entirely outside them.
While i agree getting rid of the 17th amendment is important towards restoring federalism I also recognize that our people have been so diluted by the Liberal run public “indoctrination” system that they dont even know we are suppose to be a republic rather than a tyrannical democracy.
we would be more realistic towards substituting the 17th amendment for something more anti-Washington elites such as direct State legislator issued recalls for Senators.
Yes there is. Research FDR and court packing and find the laws passed to prevent such a thing.
Is this a joke?
Breyer? - Ginsburg?
These are radical socialists.
Speaking of morons...have you not heard about FDR's court-packing scheme? Don't want to go there.
It depends who he’d be replacing. There is something seldom discussed but if one of our conservative Justices would kick the bucket we’d have a big problem on our hands. Hopefully we pass the next two years with no more Supreme Court nominations and then win the Presidency.
Wait!
What?
** implied face palm **
Yes we do
Read the Constitution
With a right wing supermajority in the SCOTUS, the domestic Marxists can be destroyed.
Forever.
Kagan and Sotomayor is what the people who elected Obama gave us the curse of a lifetime.
Laws mean NOTHING
Ran out of wise latinas?
Looks that way
That’s what the RATS would do, but Pubs are too afraid their liberal “friends” won’t like them to play hardball.
What you said...
...and split the 9th circuit for good measure....
...dims discombobulated and mucho ululations from their girlie men.
The majority of the American voters have had it with Obama and the policies of the Democrats. Their only hope of regaining control right now is to use the invasion across the border to produce instant Democratic voters.
The other possibility is for the stupid party to pass comprehensive immigration reform. Six of one and half a dozen of the other.
The Emperor and his Congressional Court make me sick, and I don’t think the Pubbies have the guts to reverse all the crap that’s been done. The best hope is with the States and local governments to refuse to participate in unconstitutional Federal over reach.
...unless Kennedy leaves in the next month or so.
