The Supreme Court Won’t Be Getting Another Sotomayor Anytime Soon

Democrats lost the Senate, but so what? President Obama still has two more years and a veto.

But there is at least one area where the GOP’s new Senate majority makes a big difference: a Supreme Court nomination. While it’s still unclear whether Obama will get to nominate another justice, the Republican gains in November make it unlikely a liberal nominee, such as Justice Thurgood Marshall, would be confirmed. And a nominee like the two Obama-appointed justices currently sitting on the court, Elena Kagan and Sonia Sotomayor, would face a possible filibuster.

Only a true middle-of-the-road nominee — such as Justice Stephen Breyer before his nomination hearing — or a perfectly qualified, center-left nominee — such as Justice Ruth Bader Ginsburg — would be a favorite to be confirmed.

We know this thanks to research spearheaded by Lee Epstein, a professor at Washington University in St. Louis, which measured what matters in gaining Senate confirmation. As I noted in September, ideology has become the single biggest factor — the ideology both of the nominee and of the senators. Qualifications are now a secondary consideration.1 They still matter (see Harriet Miers), but even the most qualified candidate picked from an ideological pole would face a slew of opposition.

Ginsburg is not center left. She’s very far left.

And Breyer is not middle-of-the-road. He’s a typical Democrat. Nothing more, nothing less.

How about a SCOTUS of 8, just for upwards of 2 years, should Ginzy leave the bench.

There you go, 'Rats... you can have a SCOTUS of 9 with Ginzy, or a SCOTUS of 8 without.

There is nothing in the Constitution that limits the SCOTUS to just 9 morons, time to put another 6 sane RABID RIGHT WING justices on the court to rubber stamp whatever necessary measures are taken.

Time to do what needs to be done, because this is the END.

The Right either fundamentally transforms the country in 2016 right back to where it was before this degenerate communist son of a whore seized power, or it's over.

Politics aside, Justice Thurgood Marshall had a brain and earned his place on the bench. By comparison, Elena Kagan and Sonia Sotomayor are pitiful affirmative action nominees.

Ginsburg, center-left? I don’t claim to be an expert on constitutional law, but Ginsburg has always struck me as being among the most liberal, most activist judges on the court in the modern era.

If one of the five leaves, its a good bet of 8 on SCOTUS.

The double edged sword is in a 4/4 tie, nothing changes in the ruling of the lower court case heard on appeal.

She absolutely is. She’s a little more clever than some of the leftist “greats” of days gone by like Brennan or Thurgood in the sense that she is willing to make small steps to the left if that is all she can get four other justices to agree on instead of insisting on writing a 100% pure leftist opinion even if it means being in dissent, but her views are as far to the left as the Court has ever seen. In fact, some of her views on gender and race are so extreme I doubt even Brennan, Douglas, or Marshall would have fully agreed with her.

How do you figure? Filibusters have been done away with when it comes to judicial nominees. And McCain, Graham, Collins, and Kirk will vote to confirm anyone Obama nominates. Your only hope at this point is to pray, and pray hard, that Ginsburg doesn't retire any time in the next two years.

Given the precising lawlessness of the Federal injustice system this supposition seems basically illrelevent.

We have to actually have a federal court interested in upholding rather than dictating law to defend. Right now we have a federal injustice system that sees no bounds to federal powers and is currently in the process of trashing politically the foundation of human society sense day one. Frankly the Federal employees in black robes we have should be in loonies bins not presiding as self-imposing dictators as their entire civilization will soon enough be falling apart around them because of their lawless new founds assaults upon its foundation.

An aggressively inventive act by the way that no true justice could even think of because a real justices is bound by that doenst change after it was written.

The Federal court being nonthing more than a corrupt body of dictators needs to now be abolished as such and reformed if nessary to men with no such arbtary power.
