FIRST ARREST? Connecticut Man Faces Charges For Unregistered “Assault Rifle,” Standard Mags

A Milford man appears to be the first person charged after failing to comply with Connecticut’s law requiring the registration of certain firearms and standard capacity magazines:

A 65-year-old man faces an array of charges after he allegedly shot a squirrel in his yard Monday morning.

James Toigo, 258 Housatonic Dr., was charged with unlawful discharge of a firearm, cruelty to an animal, first-degree reckless endangerment, second-degree breach of peace, failure to register an assault rifle and three counts of possessing large-capacity magazines, according to a police press release.

Police were directing traffic in the area of Housatonic Drive when they heard a gunshot nearby, according to the release.

Upon investigation, police said Toigo was taken into custody after finding he had shot the squirrel. Police said they also found an unregistered assault rifle, as well as three large-capacity magazines, in Toigo’s home. Both the firearms and the magazines were taken, the release said.

In a Texas urban residential area, I know of several guys who trap the squirrel first, then shoot it, wrap it in a Wal-Mart sack, and store it in the freezer or a cool place until it can be put into the garbage can on pickup day. One marshmallow, one .22 LR or pellet, and one sack, and voila another one bites the dust. Reset trap and repeat.

Needless to say, there are many alternative ways to terminate the squirrel if noise is a problem or the resident’s aim would cause neighbours to fear for lives. Many prefer drowning to be more humane. Also, do not use high calibre ammunition as it may shorten the life of your trap. Sorry PETA, I just had to report it.

Also works for armadillos, possums, racoons, foxes, birds, cats, or any small mammal. Does not work for feral hogs.

“According to nhregister.com’s report, Milford Officer Jeffrey Nielsen said that the “assault rifle” wasn’t what Togio used to send the bushy little critter to squirrel heaven. They apparently found the gun and non-compliant mags among Togio’s collection while investigating the shooting.”

Sounds like he might have used an air rifle to kill the squirrel and then they searched his hour and found the AR.

I live on the edge of a town but in the County. Houses fairly close but with an air rifle or BB gun someone has to hear it or see the use of it and I would still be legal because I have a hunting license. A firearm like a .22 might be another matter since firearm hunting regs would kick in. I take Doves, in season, sitting on my fence with the Gamo air rifle.

Cops do this routinely when they shoot people's pets...They do like every few days...

Its real risky to be shooting in a residential area like that. I do it, I'm as careful as possible, but things can happen.

I use a Henry mini-bolt with a red dot on it and Aguila Super Colibri rounds. They are powderless 20grain rounds and run off the primer only. I doubt they would crack a window beyond 100ft, but it's still risky. We only take shots above 45 degrees or so while they are in the trees. Problem is, the ammo is extremely inaccurate and kill shots are hard to come by when they are all fat for winter. I'm lucky to get 4" groups at 50ft with them, but I just can't convince myself to light off anything more powerful in a neighborhood like this.

Two times now I've had those nasty tree rats eat the wiring under the hood of my truck, once it fried the computer too. They've done over 4 grand total in damage to it (I keep it under a cover, it's a spare, rarely driven vehicle). Every time I see one of those little bastagez in my yard I see red.

80% of people on jury duty are useless non-essential types looking to get a few days off with pay.

Not really the type to have the intelligence to engage in Jury Nullification, especially if the defendant isnt the right skin color.

In my town in TX, it is legal to shoot a firearm on one’s property as long as the bullet from the firearm does not cross the property line of one’s property..If one has the permission of an adjoining landowner, then, it’s okay if the bullet crosses their property line.

I’ve been dispatching raccons, and possums for over twenty years, and my next door neighbor, and the neighbor behind me have given me permission to kill nuisance varmints on their property. I use a .22lr. I am always shooting in a downward trajectory, but I’ve never missed.

I have an antigun friend who thinks this is a sign of my scariness, and that it would be better to dispatch them by bashing their brains out with a shovel. I think the .22, per our game warden is the most humane effective way to dispatch a varmint.

I live in Texas in a rural area. In my neighborhood several individuals have firing ranges in their back yards. When I am shooting I call the local sheriff department and tell them I am shooting and for how long I will be shooting. They notify their deputies so they will not be bothered by anyone that calls in.

The first time I was shooting on my range I had an unexpected visit by the local sheriff deputies. They were most courteous and asked to inspect my range. My range has a backstop that is 16 feet tall. They were satisfied with the safety of my range and left. They were very professional and courteous.

They have never came back as I always call when I am shooting. This is Texas and that is the way it should be.
