FIRST ARREST? Connecticut Man Faces Charges For Unregistered “Assault Rifle,” Standard Mags

A Milford man appears to be the first person charged after failing to comply with Connecticut’s law requiring the registration of certain firearms and standard capacity magazines:

A 65-year-old man faces an array of charges after he allegedly shot a squirrel in his yard Monday morning.

James Toigo, 258 Housatonic Dr., was charged with unlawful discharge of a firearm, cruelty to an animal, first-degree reckless endangerment, second-degree breach of peace, failure to register an assault rifle and three counts of possessing large-capacity magazines, according to a police press release.

Police were directing traffic in the area of Housatonic Drive when they heard a gunshot nearby, according to the release.

Upon investigation, police said Toigo was taken into custody after finding he had shot the squirrel. Police said they also found an unregistered assault rifle, as well as three large-capacity magazines, in Toigo’s home. Both the firearms and the magazines were taken, the release said.

Yer correct, anything bigger than a b.b. gun is over kill. I shoot garden destroying rabbits from my patio with a b.b. gun, I would not consider anything bigger.

Find out when the case is going to court and have liberty minded folks volunteer for jury duty or treat this like the OJ trail. Identify the jurors and make it impossible to convict. It’s an opportunity for jury nullification.

He was shooting in town. The rifle he shot the squirrel with was just the one that got their attention. The “assault” weapon was found after searching

There is no mention in the site doc as to where it was. A street address does not mean it is an unlawful area. Of course, the commenters are already saying it was in a residential area. And in many residential areas it is lawful to discharge guns, such as in mine (not CT). Somebody will need to dig out the details. I checked two other sites but not much more than this one.

A squirrel got the anger of my old man up more than common sense. He asked for my air rifle and I said “Um, I’m not sure this is a good idea Dad.”

He would have none of it, that squirrel had eaten his last fill of bird seed. He took careful aim and “pop”.

Missed the squirrel. Broke both pieces of glass on either side of the feeder, with the seed cascading onto the ground. He just looked at me with a half-grin, and sheepishly said “Here. Take your gun. I guess I’ll be cleaning THAT mess up.”

I’d use a nice .177cal Gamo air rifle

That'll get you arrested just as quick in many places including where I am (out west in a small town).
