N.Y. Assembly Speaker Silver: ‘We Are Going To Ban Assault Weapons’

ALBANY (CBSNewYork) – The New York State Legislature was poised Monday night to pass the first gun control measure following the Newtown school massacre. This as the vice president was set to unveil federal proposals to end gun violence on Tuesday.

Albany lawmakers have reportedly ironed out the kinks, allowing them to enact new gun control measures in the wake of the Sandy Hook Elementary School mass shooting. Assuming the new bill passes — it was sent to both house of the Legislature on Monday night — it will turn into the toughest set of gun control laws in the country. ...

The new state legislation will:

* Limit ammunition clips to seven. It’s now 10

* Force gun owners to renew their licenses every five years

* Stiffen penalties for using a gun in the commission of a crime

* Stiffen penalties for bringing a gun on school property

* New restrictions on the assault weapons already owned by New Yorkers

“They will be basically not permitted to be transferred. They will be grandfathered in but not in terms of a transfer. There will be a registry,” Silver said.

Biden Proposals Include Framework for Gun Registry and Confiscation

Up to 50-80% of all guns in circulation could be covered

Press reports now make it clear what Vice President Joe Biden’s gun control package will look like. Biden wants to impose:

* A Feinstein-like semi-auto ban which, according to experts who have done the counting, could ban up to 50% of all long guns currently in circulation and up to 80% of all handguns. Incidentally, if you wanted to keep the AR-15 you currently have, you would have to have a 6-month FBI background check, be fingerprinted, and get a machine gun-type license.

* The framework for national gun registration and confiscation by requiring every gun transaction to have a Brady Check.

* Supposed “toughening” of anti-gun trafficking measures, but without doing anything about the man responsible for allowing more gun trafficking than any other American — Attorney General Eric Holder (with his Fast and Furious program).

Let us backtrack and explain a couple of things: Increasingly ATF is going into gun dealers and xeroxing all of the 4473’s. This is illegal under McClure-Volkmer, but, in case you hadn’t noticed, Obama is increasingly ignoring the law when it inconveniences him.

Thus, if every gun transaction in America must have a Brady Check, every gun in America could presumably be fed into a national registration system by ATF by simply copying the 4473’s.

New York Governor Andrew Cuomo -– a man who gives you a pretty good idea of where gun control is going -– said, on the front page of the New York Times, that “confiscation” of firearms is an option. Obviously, having a registration list makes such a task much easier.

But what about so-called large-capacity magazines? Well, Republicans like Georgia’s Phil Gingrey have talked about the possibility of banning them. However, there are many problems with this.

First of all, millions of gun owners own these magazines for defensive purposes. To take away a homeowner’s right to choose these devices will simply make honest citizens less safe — especially, when they are facing multiple attackers.

Moreover, police have sometimes had to fire 20-30 rounds to finally stop just one drug-crazed individual from shooting. This just underscores why, quite often, good guys will need more than just six-shooters.

Second, there are tens of millions of high-capacity magazines in circulation. What are you going to do about them?

Third, changing magazines (or switching guns) is not a big deal for people like Adam Lanza.

Fourth — and perhaps most important –- this is a game the anti-gun zealots have played before: They threaten to kill the Second Amendment, and then negotiate their way back to “merely” eviscerating it.

Or put another way, they threaten to shoot us in the head to get us to agree to cutting off our fingers.

The only way that America’s gun owners are going to have peace over the next decade is to stop ALL gun control -– as we did after Columbine –- and then defeat compromising legislators running for reelection in 2014.

ACTION: Click here to contact your Senators and Congressmen. Demand that they oppose ALL gun control — including magazine limitations and universal background (registration) checks — being proposed by the Biden commission.

In the first day of a sixth month legislative session the N.Y.S. Senate passes “emergency” gun control. Three day review period promised by Cuomo, not a chance.

And now hundreds of thousands of New Yorkers own illegal guns and magazines -retroactively.

But….
(I live next to New York, in Connecticut. Same situation as you.)

It doesn’t matter that NY state has a number of “right-minded” folks upstate.

What DOES matter (if one is an “upstater”, or if one lives here in CT) is that you live in a state where folks of your persuasion are hopelessly outnumbered by those of the left. Outnumbered by people who embrace a political outlook that is 180 degrees removed from your own.

What this means is that you live under their diktats, because you don’t have sufficient numbers with which to voice and influence public policy within your state. Like it or not (and I know you don’t), that’s the way it is, and that’s the way it’s gonna remain.

The solution? If you want to be able to live amongst those “of the same voice”, and to effectively exercise it again in the political arena?

It’s easy — move OUT of New York state, to a state in which the population is more congruent to the beliefs you embrace.

That’s the choice you have. I realize it may not be the best when viewed from your personal perspective.

But … so long as you, or I, or any other conservative chooses to remain in the deep blue states, we tacitly consent to be ruled by the left. Whether you (or I, or any other conservative) can endure that is a personal decision. But that’s how it shall be.

Having written that, the current gun-control legislative putsch is but one more indicator of the increasing philosophical divide between the red and blue states. For a contrast “from the right”, look at Wyoming, which has had proposals introduced in their legislature to actively oppose gun control efforts by the federal government.

How wide will the chasm grow, until the two sides break apart?

I’m always suspicious of anyone moving here to my little redneck corner of Central Alabama from one of the blue states. Damn Yankees move down here to get away from the hell hole they created and before you know it they’ve created the same thing wherever they move to. Just like locusts. Florida’s not gone yet but its headed that way.

Maybe if there was a good way to identify the “good ones”?

Steve Katz is asking why the assembly is being bullied by the governor. Why are they having to pass a bill without the 3 day notice.

Making criminals of law abiding citizens.

This law is turning him into a criminal. He is not going to leave his wife when he has to leave her and the children alone with only 7 bullets in his gun.

I hear what you’re saying, and I understand it. Hell, I don’t want to move to a state that’s full of New Yorkers either. But what most people don’t realize is that there are a lot of New Yorkers who are very conservative, and we’ve been banging our heads against the wall for years. We stay for a variety of reasons - my main reason is that my parents are elderly (I hate writing that) & I don’t know how much longer they’re going to be around. They still live in Central NY (which my conservative father loves), and I want to remain nearby. Right now, they’re a fairly short drive away. But last night’s action really was the last straw for me - planes fly into Central NY too.

A lot of conservative New Yorkers DO try to make a difference. We call & write our “representatives”, we volunteer for conservative campaigns, we attend town hall meetings, we protest (my husband & I drove to DC for the March for Justice in the late ‘90s & the Tax Day Tea Party protest a couple of years ago, we’ve protested locally, and we’re heading to Albany this Saturday for the Guns Across America rally. Which, incidentally, can no longer help NY - but we’re trying to make our voice heard on a national level, for the remaining states that still have a chance.)

I know we all look alike, but please don’t automatically lump us in with the idiots who have destroyed this state. There are more of us than you realize, but we’re dwarfed by the huge population in NYC.

Felix Ortiz Democrat- Health professionals in the Dept. of Mental Health will determine whether we are too crazy to own guns and report us to the state police.

So a division of the government will determine if we can have guns from the mental health perspective.

If a person is crazy and he doesn’t have a gun the family will be investigated too.

The information will be confidential ( I really believe that one). He’s claiming it will be confidential, but it’s not in the bill that it will be.

There’s not exactly a lot I can do about liberal northerners moving here or any other red state for that matter. It’s sure not perfect here but I think you would like it. Ga, Tx, Tenn lots of great places and some communities are extremely conservative you just have to do a little research.

But, I don’t know, the entitlement mentality is pretty hard to overcome. I’m pretty sure in the next 30 years or so the takers will have their way and I’ll be in the minority here.

The Constitution has been “the peoples” only protection against a tyrannical government and when folks decided it doesn’t say what it says in plain language then that was the beginning of the end of our Republic

According to the Facebook event, the NY rally starts at 12, at the NYS Capitol building on State St. I’m riding a bus up, through an organization I belong to called Long Island Firearms - our original bus is filled so we’re trying to see if we can get enough people together for a 2nd. If you’re on Long Island & interested in riding the bus, there’s info on the LI Firearms website (www.longislandfirearms.com).

This protest is supposed to be occurring in all states on Saturday. There’s a lot of info available on Facebook, for each state.

Bill Reilich talks about his son’s friend dying from a gun shot. The person was mentally disturbed. This bill is not going to stop this person or the man with the box cutters, or the hammer, etc. The focus should be on the problems, (mental health) not guns.

Supposedly, you don’t have to turn your gun in just register it. Same with over 10 round magazines, except have to turn in pre 1994 magazines.

Have to put only 7 rounds in the 10 round magazine.

So you're saying that the state can violate the law under Obama Care.

(1) WELLNESS AND PREVENTION PROGRAMS- A wellness and health promotion activity implemented under subsection (a)(1)(D) may not require the disclosure or collection of any information relating to–`(A) the presence or storage of a lawfully-possessed firearm or ammunition in the residence or on the property of an individual; or`(B) the lawful use, possession, or storage of a firearm or ammunition by an individual.`(2) LIMITATION ON DATA COLLECTION- None of the authorities provided to the Secretary under the Patient Protection and Affordable Care Act or an amendment made by that Act shall be construed to authorize or may be used for the collection of any information relating to–`(A) the lawful ownership or possession of a firearm or ammunition;`(B) the lawful use of a firearm or ammunition; or`(C) the lawful storage of a firearm or ammunition.`(3) LIMITATION ON DATABASES OR DATA BANKS- None of the authorities provided to the Secretary under the Patient Protection and Affordable Care Act or an amendment made by that Act shall be construed to authorize or may be used to maintain records of individual ownership or possession of a firearm or ammunition.`(4) LIMITATION ON DETERMINATION OF PREMIUM RATES OR ELIGIBILITY FOR HEALTH INSURANCE- A premium rate may not be increased, health insurance coverage may not be denied, and a discount, rebate, or reward offered for participation in a wellness program may not be reduced or withheld under any health benefit plan issued pursuant to or in accordance with the Patient Protection and Affordable Care Act or an amendment made by that Act on the basis of, or on reliance upon–`(A) the lawful ownership or possession of a firearm or ammunition; or`(B) the lawful use or storage of a firearm or ammunition.`(5) LIMITATION ON DATA COLLECTION REQUIREMENTS FOR INDIVIDUALS- No individual shall be required to disclose any information under any data collection activity authorized under the Patient Protection and Affordable Care Act or an amendment made by that Act relating to–`(A) the lawful ownership or possession of a firearm or ammunition; or`(B) the lawful use, possession, or storage of a firearm or ammunition.’.

In a nutshell, under Obamacare you can’t be required to provide information to doctors or health plans about legally owned guns, nor can your insurance rates be affected by such ownership. The government, in the execution of Obamacare, cannot collect information about or use information from other government databases about legally owned guns.”

Assuming that this site is right and it refers only to doctors or health plans, what about doctors who are going to diagnose whether we are crazy or not. Seems like NY is still violating the law to turn the person in for gun ownership.

I’m already seeing some initial steps in this direction. I don’t know that any lawsuits will succeed in NY, but they will be filed. (We’ve been trying the Legal angle for a while in NY - the liberal judges make it difficult, but we keep trying. For instance, there’s a case in Westchester that challenges the downstate requirement of “just cause” for a licensed gun owner to carry. It’s been going through the courts for quite a while, step by step. The latest ruling was against the plaintiffs, but that wasn’t a surprise & it’s now being appealed.)

I started the search for a job to leave NY to night.

Come to Florida. No state income tax and the best gun laws outside of Vermont and Alaska in the nation. They call us the Gun-shine State for a reason. Better weather here too.

You are bit confused.

1st, no Jew died during the days of darkness, the darkness occured only among the Egyptians (see vs.Ex.10:23)

2nd. The Jews are said to have come out in armies in Ex. 12:51).

Thus, Ex.13:18 tells us that they came out 'harnessed',(by fives) in other words, by ranks.

So, in the beginning of your comment you state that the Hebrew can only mean 'armed' but then state that it can also mean 'divided by five'.

That is how the KJB translated it, hence the word 'harnessed'.

Other modern versions have 'orderly ranks' (NKJ) or 'martial array'(NAU).

The point being they left in order not as a mob.

You stated what the Hebrew was and then said the translation was based on 'context'.

The Hebrew can also refer to 'fives' as well, as you yourself noted.

So, what was being pointed out was not arms, but organization.

The KJB translation was correct.
