The father whose 1-year-old twins died after he allegedly forgot them inside a hot car in the Bronx for eight hours on Friday has been charged in their deaths, police said.
Juan Rodriguez, 39, was charged with two counts each of criminally negligent homicide and manslaughter for leaving his infant twins, Mariza and Phoenix, in the back seat of his Honda Accord while he was inside James J. Peters VA Hospital in Kingsbridge, where he works as a social worker.
The father, who lives in Rockland County, told cops he parked at his job at 8 a.m.
He only realized he left his kids behind once he drove off after work at about 4 p.m., police said.
A passerby called police after witnessing Rodriguez screaming on the side of the road at Kingsbridge Terrace and Kingsbridge Road, police said.
The babies werent breathing and were foaming at the mouth when EMS arrived. They were pronounced dead on scene.

If it’s proven he didn’t intend to harm his children, then the loss is punishment enough.

Agreed. We’ve seen criminal intent more than once before.
The family had just had a big party for the twins and the neighbors said they fussed over the children constantly and never left them unattended.
Probably what happened - as it does in most of these cases - was a change in the routine of the parents. Perhaps their mother normally dropped them off and he had forgotten that he had them and they were in the back seat (since very small children frequently go to sleep in the car). I read about some new device they are developing that would alert parents and IIRC not allow the door to lock until it was deactivated, sort of the way you cant lock the doors on a modern car now if your keys are inside.
In any case, the reason the police were called was that motorists reported a man screaming hysterically outside an open car door so I think we can rule out any intention on his part. This is such a sad story, but so common.

He didn’t even think about his kids the WHOLE DAY, which would have made him realize, “Oh my God they’re in the car!!!”
He hasn’t begun to suffer enough.
How sad. He is guilty of negligence, unfortunately. He will have the rest of his years with this great weight upon him. If it was an accident, which by all accounts it sounds like one...I would not be surprised if he just offed himself because of guilt and shame, which would also be very unfortunate.
How does one keep on living knowing that due to one’s own stupid actions, the lives of their newborn children are no more.
I never buy any of these, Honey, I forgot the kids death scenarios. Unless the child is riding in the back of a box truck, how do you leave your child ? I dont buy it, nope, not for a second.
I can see a change in the routine being a factor.
Thinking back to when our kids were infants, I remember the gut-wrenching feeling about my responsibilities for the morning or whatever. It was so easy to get lost in the previous habits — work habits in my case. But fortunately, it was only paranoia.
There was never an instance where I had to haul the kids to my workplace. My wife and I agreed it would best for her to stay home with the babes/kids. Mom at home was something we both wanted. It’s been financially difficult but worth it beyond any cost.
BTW, those gut-wrenching moments were random but valuable reminders of what could go wrong. Thankful I had them.

How did your habits change after your first child was born?
I suspect a post birth abortion.
Twins. Too much and too expensive to deal with.
Leaves them in a hot, sealed unattended car.
A death sentence for them. A burden lifted for him (or so he believes).
Im just not buying I forgot they were back there...

If Dad is subjected to court-ordered random drug-testing for a year and wears an electronic ankle tether for that first 3 or 4 months and comes up clean and cooperative, then maybe he could be released early from an initial 2-year probationary period for gross or criminal negligence. However, he would have to be prosecuted and at least he would have had his day in court, and those two babies deserve to have their day as well.
There is a 3rd child. A 3 yr old he dropped off in Westchester on way to work. Family lives in Rockland County.
That’s a Sharp observation.

They’ve been saying that the temperature in cars can get to 150 or higher!!

Change in routine coupled with rear-facing car seats and parental exhaustion (common enough with parents of young kids) make a potentially lethal cocktail that cause me to suspend judgment.
Rear facing carseats kill.
They also save lives.
But it is a percentage game and bureaucrats, lawmakers, and cops should STFU.
I have never bought that I forgot about the kid(s) in the back seat line. Not once did he happen to glance in the rear-view mirror and see them? Not once did they make a noise while he was driving to work to remind him they were there? Really?
