Dr. Rand Paul Releases Statement on National Emergency Vote

WASHINGTON, D.C. – Today, U.S. Senator Rand Paul (R-KY) released the following statement after voting to disapprove of the national emergency declaration regarding the border:

“I stand with President Trump on the need for a border wall and stronger border security, but the Constitution clearly states that money cannot be spent unless Congress has passed a law to do so.”

On March 4, 2019, Dr. Paul introduced the Border Enforcement, Security, And Funding Enhancement (BE SAFE) Act as a constitutional, fiscally responsible alternative. The BE SAFE Act would impose a $2,500 border security fee on each new green card issued to fund the construction of new border walls or physical barriers and other immigration-related improvements. The bill also directs U.S. Citizenship & Immigration Services (USCIS) to deposit all fees paid under the BE SAFE Act into a new Border Security Enhancement Fund at the U.S. Treasury. Only the president would be authorized to use the Fund for certain immigration-related purposes.

Just because i agree with a constitutional principle does not mean we were ever willing to give the Kenyan a pass on anything

If libertarians are for such a principle, that means they are against the US Constitution, particularly the Guarantee Clause of Article 4 Section 4:
The United States shall guarantee to every state in this union a republican form of government, and shall protect each of them against invasion; and on application of the legislature, or of the executive (when the legislature cannot be convened), against domestic violence.
Trump is obviously upholding the Constitution on this vital matter, whereas the libertarian in question opposes it.

Apparently this a—hole never heard of the “Implied Powers” of the president. The president has power to enforce the law and fulfill his duties, even when such powers are not expressly granted by the Constitution. If it is granted that the president has the responsibility to protect the states from invasion, then it necessarily follows that he has the power to do what is necessary to protect the states. That would involve spending money of course, no matter what he decided to do.

Yeah - I went to his comment on twitter and told him: “Ummm - the Congress already said the money could be spent or it wouldn’t be sitting there...when the Congress controls every penny, it seems that many of those pennies get diverted by the same congress and wasted..but try to use the money properly and you balk...don’t be a prig.”
