Judicial Watch: DOJ Admits Lois Lerner’s Emails Exist

By Joel Gehrke

August 25, 2014 3:11 PM

A Justice Department official admitted that former IRS official Lois Lerner’s apparently missing emails actually exist on a backup server, but the government doesn’t plan to retrieve them.

“A Department of Justice attorney told a Judicial Watch attorney on Friday that it turns out the federal government backs up all computer records in case something terrible happens in Washington and there’s a catastrophe, so the government can continue operating,” Judicial Watch president Tom Fitton told Fox News’ Shannon Bream.

“But it would be too hard to go get lois lerner’s emails from that backup system,” Fitton continued, paraphrasing the DOJ official. “So, everything we’ve been hearing about scratched hard drives, about missing emails of Lois Lerner, other IRS officials, other officials in the Obama administration, it’s all been a pack of malarkey. They could get these records, but they don’t want to.”

Fitton said his group plans to ask a federal judge to order the IRS to hand over the emails, which conservative opponents of Lerner want to see in order to determine if there is a link between President Obama’s team and the IRS’s targeting of Tea Party groups.

“If this backup system is working, Lois Lerner’s emails are there,” Fitton said.

At this point, we only obey to avoid being shot, not because they have legitimate authority, not from the “consent of the governed”.

When enough people decide that we don’t want to be “governed” under those conditions, it’s gonna get ugly.

Yet another home run from an astute Freeper.

Typical citizens are going to try, but their little purse pistols, holster guns and grandad’s old shotgun are not going to cut it against gumint drone missiles, an American Muslem force, cartel gang enforcers (flowing across a borderless border puddle), and the roaming rabble evil.

Calm down, sister. There are nearly 100 Million armed American citizens. That's a third of our population. Many of them possess multiple firearms - quite a few of which are easily equal to anything the military carries.

In addition to that, a huge percentage of that number are in possession of high powered hunting rifles, which are capable of taking out large game from great distances. Most of those people are also quite expert in doing so.

Lastly, there are no more than about 1.5 million active duty military personnel under arms at present. I'll remind you that our entire armed forces were tied up in the country of Iraq for ten years by no more than (an estimated) 1,500 jihadist militants.

I truly understand your concern, but really, the odds are on the side of the people in this equation.

I work for a large multi-national bank. We've been subpoenaed by the Federal Government to produce records, emails, policies, etc..

If we ever used the excuses the Federal Government is using here, someone from our bank would be found in contempt of court and hauled off to jail, at least until such time we produced the records/emails in question.

And then, all hell would break loose. The shitstorm our bank would be subjected to would make Bank of America's 16 Billion dollar fine look like peanuts.

So I have one question: Why isn't Lois Lerner in jail?

Why wouldn’t they want to release the e-mails? This is the most transparent administration in history.

....and nothing will be done....and no one will be held accountable. it’s like we expect this to happen now. I’d be SHOCKED if someone in the government did the RIGHT thing for a change!

Why isn't Lois Lerner in jail?

Good question, according to Lois Lerner, she's as pure as the driven snow!

May 22, 2013 - Lois Lerner Statement to Congress (House Oversight and Government Affairs Committee).

MS. LERNER: Good morning, Mr. Chairman and members of the committee. My name is Lois Lerner, and I’m the director of exempt organizations at the Internal Revenue Service. I have been a government employee for over 34 years.

I initially practiced law at the Department of Justice and later at the Federal Election Commission. In 2001 I became — I moved to the IRS to work in the exempt organizations office, and in 2006 I was promoted to be the director of that office.

Exempt organizations oversees about 1.6 million tax-exempt organizations and processes over 60,000 applications for tax exemption every year. As director, I’m responsible for about 900 employees nationwide and administer a budget of almost $100 million.

My professional career has been devoted to fulfilling responsibilities of the agencies for which I have worked, and I am very proud of the work that I have done in government.

On May 14th the Treasury inspector general released a report finding that the exempt organizations field office in Cincinnati, Ohio, used inappropriate criteria to identify for further review applications from organizations that planned to engage in political activity, which may mean that they did not qualify for tax exemption.

On that same day, the Department of Justice launched an investigation into the matters described in the inspector general’s report. In addition, members of this committee have accused me of providing false information when I responded to questions about the IRS processing of applications for tax exemption.

I have not done anything wrong. I have not broken any laws, I have not violated any IRS rules or regulations, and I have not provided false information to this or any other congressional committee.

And while I would very much like to answer the committee’s questions today, I’ve been advised by my counsel to assert my constitutional right not to testify or answer questions related to the subject matter of this hearing. After very careful consideration, I’ve decided to follow my counsel’s advice and not testify or answer any of the questions today.

Because I’m asserting my right not to testify, I know that some people will assume that I’ve done something wrong. I have not. One of the basic functions of the Fifth Amendment is to protect innocent individuals, and that is the protection I’m invoking today.

Thank you.

If this article is accurate, why is there absolutely nothing posted about it on the judicialwatch.org web site?

Whoa whoa...speaking as Admin who has many years before retirement, let’s not throw IT under the bus. No technical person, with knowledge of this system, has gone under oath saying “It’s too hard to do a restore”. These are all political hacks covering their collective asses.

The problem with that is that we do not have a penal colony large enough to accommodate all of them!

If they don’t pay today, God made hell plenty big. I pray they repent and do the right thing, face a real legal justice. If not God will make them pay.
