WASHINGTON -- The Supreme Court on Monday put same-sex marriages on hold in Utah until a federal appeals court can rule on whether the state law banning the practice violates the Constitution.
The unsigned, one-paragraph order did not spell out the court’s reasoning in the case -- orders that put lower-court decisions on hold frequently do not do so. The order did not indicate any dissents.
The decision will block further same-sex marriages in Utah for at least several weeks. The 10th Circuit Court of Appeals, based in Denver, has told both sides in the dispute to submit legal arguments by the end of this month.

Liberals are raging against Sotomayor over at the Washington Compost. These people become more deluded every day. Judge Shelby needs to be impeached and removed.
And one spineless governor should not have the authority to accept the yoke on behalf of the entire state.

I honesty didn’t anticipate this.
I agree - but tell that to California (Proposition 8 shutdown by a 'homosexual' judge -- no conflict of interest there). Hopefully things will fare better for the Utah folks. Presumably they don't also have a left-wing Attorney General and Governor running interference.
The half-quotation marks should have been around 'judge' and not homosexual.

There was absolutely NO call for the Governor to order clerks to violate the state's Constitution. These licenses were COUNTERFEIT because, minimally, the forms required did not conform to the new structure, requiring "bride" and "groom" to be manually struck out.
Frankly, I am surprised. I expected “The Wise Latina” to dodge this one.

Nothing got into her. She simply delayed the inevitable.
If she had denied the stay request, Utah would have had the right to submit it to a second justice of their choice per standard SCOTUS procedure. Utah would have chosen Scalia or Thomas. Either could, and likely would, have granted the stay or referred it to the whole court as Sotomayor did.
Sotomayor just circumvented that second stay request because she knew it was inevitable and simply referred it to the whole court herself rather than make Utah go through the legal motions.
But they do. And the judiciary has had that power with the consent of the legislative and executive branches for over 200 years.
