No, it would not.
You have to be convicted in a court of proper jurisdiction before you're guilty of a felony. They also have to bring charges of a criminal nature. The ACA specifies that no criminal charges may be brought for either not getting insurance or paying the penalty. So, no, it is not a felony.
The IRS will change that on a whim without Congress or Senate, or even the President.
Really though, why not, our whole legal system is being regulated REGULATED
by laws that are not passed by Congress. Laws that can land anybody in Prison.
It needs to stop.

Now, you can lawyer up & take them to court, but the probable legal expense will far exceed Obamacare insurance premiums, even if you win in court. The math is fully loaded AGAINST you.
So, if you are dirt poor, with nothing in the bank & not a homeowner, you have nothing to fear. But, for the most of us who have worked long & hard for what few assets we possess, WE ARE SCREWED.

Since we already have Rationed Medicare with Rationed Tricare Life for Military over 65, I think it means you are automatically on 0’care if you like it or not.
Closest Military base from us is just 22 miles for your meds or express scripts, which I would not trust if my life depended on it. GENERICS is all they want to use, not all generics are equal to the name brand and have more side effects because of the fillers. I can’t see narcotics being left in your mail box, open invite to theives looking for pain meds etc. And they are hard to deal with.
They’d be just fine with that.
This is not about healthcare. It’s about wealth redistribution. If you sign up and pay the sky high premiums that pay for others healthcare or you pay the fine for not signing up they’ve confiscated and redistributed the money you’ve earned.
Don't be surprised to see the IRS question your tax filing as regards the Obamacare requirements. A process we all “love” - income tax filing - will become an even bigger nightmare.

If there are no penalties are charges for not paying the fine, why bother to pay it.

And there is a number that if the insurance costs more than that percent of your income, think around 9%, then you are exempt. Need to find out if that number is just premiums or total out of pocket plus premiums. I checked the rates on CoveredCa for us and the total would be right at 1/3 of our income.
A caller to Mark Stein (filling in for Rush) raised that very question yesterday. I think its not necessarily a cut and dried problem. For example, exempted categories (Amish, Christian healthcare co-ops, etc) would not sign up, and yet be compliant as being by operation of law exempt.
Whether those who choose direct resistance would be considered felons would be a question I think of the seriousness and the legal history of the offense. There are traditional, serious violations, such as murder, that ate not even violations of federal law, that are considered felonies. But there are much less serious infractions that are considered “magesterial” offenses, like not paying required fees or fines etc. As the law itself explicitly trivializes the penalty for non-payment, it seems likely you could make a case the government deems it not serious, and therefore not a felony. So to make it a felony, the law itself would have to change dramatically, and I don’t see that happening. JMHO.
Not only that, but being a tax it gives standing as a taxpayer to file suit on free exercise of religion grounds, one of the only ways to sue on a tax. Whether Roberts meant to do that is not certain, but it is an interesting byproduct of his decision. It means that if you aren’t Amish but dont want to fund abortion, you have the basis of a suit, because the government is “establishing” the Amish etc in preference over you. That’s illegal and well within SCOTUS free exercise precedent. Why this is not being pursued on a class action basis I don’t know. It seems like it has real potential.
