CHARLESTON, W.Va. A criminal charge has been dismissed against a West Virginia middle school student who refused a teacher's order to remove a National Rifle Association T-shirt he wore to school.

Logan County Circuit Judge Eric O'Briant signed an order dismissing an obstruction charge Thursday against 14-year-old Jared Marcum stemming from an April 18 incident at Logan Middle School.

Marcum was charged after a police officer told him to stop talking, but the studen

I fully concur. Leftist extremists understand nothing about rights; they do, however, understand money. Suing the vermin for a bundle of money is the only way to protect other kids from suffering the same predations.

A classmate of my daughter's got an expensive education at one of Pittsburgh's premier private universities all paid for by our local school district's insurance company.

He was a good kid and honor student who had the unfortunate experience of calling into the homework hotline at about the same time a bomb threat was called in.

They traced his cell phone number and had him hauled in to make an example of him because the school was getting heat for suspending more students with protected minority status than white kids. Even though his explanation was clear, concise and even proven, the PC principal didn't want to let it go because the actual bomb threat number of origin was untraceable and this kid was a convenient scapegoat.

So he was expelled, charged and put into juvenile detention before his parents hired an expensive lawyer to prove his innocence. By that time, of course, the principal wanted to reinstate the kid and offer a fake apologize, but the parents pursued it to the logical conclusion.

I'm glad things worked out for my daughter's classmate, but I'm equally sorry to report our PC principal still has her job.

Come Out Ye' Black And Tans

I was born in the Dublin street
Where the loyal drums do beat,
And the loving English feet walked all over us;
And every single night when me dad would come home tight,
He'd invite the neighbours out with this chorus:

Come out you black and tans,
Come out and fight me like a man,
Show your wife how you won medals down in Flanders;
Tell her how the IRA made you run like hell away,
From the green and lovely lanes of Killeshandra.

Come tell us how you slew
Them ol' Arabs two by two,
Like the Zulus they had knives and bows and arrows;
Of how bravely you faced one with your sixteen-pounder gun,
And you frightened all the natives to the marrow.

Come out you black and tans,
Come out and fight me like a man,
Show your wife how you won medals down in Flanders;
Tell her how the IRA made you run like hell away,
From the green and lovely lanes of Killeshandra.

Come let us hear you tell
How you slammed the brave Parnell,
And taught him well and truly persecuted;
Where are the stares and jeers that you proudly let us hear,
When our heroes of sixteen were executed.

Come out you black and tans,
Come out and fight me like a man,
Show your wife how you won medals down in Flanders;
Tell her how the IRA made you run like hell away,
From the green and lovely lanes of Killeshandra.

Oh! Come out you British Huns,
Come out and fight without your guns,
Show your wife how you won medals up in Derry;
You murdered sixteen men and you'll do the same again,
So get out of here and take your bloody army.

Come out you black and tans,
Come out and fight me like a man,
Show your wife how you won medals down in Flanders;
Tell her how the IRA made you run like hell away,
From the green and lovely lanes of Killeshandra.

Oh! Come out you black and tans,
Come out and fight me like a man,
Show your wife how you won medals down in Flanders;
Tell her how the IRA made you run like hell away,
From the green and lovely lanes of Killeshandra.

Since when is it a crime to talk, doesn’t matter what the said, he could have called the officer a pig, or anything else, it is not a crime.

Not say the kid should not be severely reprimanded by his parents, if he used such language, but arrested and charged no way.

Many police and government school officials are more interested in power and their own egos than the welfare of children.

They are perfectly willing to send a child to prison for any slight or public embarrassment.

Unfortunately, it wasn't a 'person' that railroaded him, but rather a school district, the police/Sheriff and county attorney. That's a tough fight, and thankfully a judge put a stop to it.

Otherwise civil charges.

Federal criminal proceedings are being considered against the school administrators and their accomplices.

18 United States Code §ection 241

If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same; or

If two or more persons go in disguise on the highway, or on the premises of another, with intent to prevent or hinder his free exercise or enjoyment of any right or privilege so secured—

They shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, they shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death.

He had to sweat charges for exercising his First Amendment rights. The fact that the charges were dismissed isn’t even the point. They’ll drop the charges, after all the hassles and attorney’s fees have been endured. So people won’t wear NRA tee-shirts anymore.

Sued for what? Having a stupid dress code? Can I sue my place of work for not letting me wear my “No Fat Chicks” t-shirt?

Listen, it was a stupid decision, but it was the school’s decision to make. Their house, their rules. Don’t like it? Join the school board and change it, or home school.

Everybody wants to be a special snowflake now and think they are exceptions to the rules. This would be a good lesson for the kid: sometimes life isn’t fair.

Agreed. That's what I would've done for my daughter when she was that age 20+ years ago. Unfortunately, in TODAY'S hotbed of liberalism that is the school system, your dad would have marched in to the Principal and been perp walked out in 'cuffs. Sad, but true. When the cops start TASING five year old kids for being unruly in the principal's office, all bets are off. That TASING story, btw, is old news too.

Sorry, genius there was no prohibition about T-shirts in the dress code. Some teaching tyrant decided he didn't like the shirt and ordered the kid to take it off. He refused. The school called the cops on him. The cop arrested him because he was trying to explain what was going on. Then the idiot DA was going to press charges. After the news spread, the DA wanted to gag the family "for the kid's own good." A judge had reporter thrown out of the courthouse because she wanted to attend the proceedings about the gag order. When they realized the kid wasn't going to plead to a lesser charge and pay some fine, and the public was with the kid and against the government bullies did they actually drop the charges.

Make sure you put NRA T-shirts on your kid's back to school list. You can irritate libs and perhaps fund his college education with the lawsuits.

When you hear an agreement like that, doesn't it mean that you have a good case?
But even if that is what the agreement was, they could press for criminal charges.
