Michigan Police Could Search Cell Phones During Traffic Stops [what's a 'constitution'?]
Slashdot ^ | 4/19/11 | timothy

SonicSpike writes

"The Michigan State Police have a high-tech mobile forensics device that can be used to extract information from cell phones belonging to motorists stopped for minor traffic violations. The American Civil Liberties Union (ACLU) of Michigan last Wednesday demanded that state officials stop stonewalling freedom of information requests for information on the program. A US Department of Justice test of the CelleBrite UFED used by Michigan police found the device could grab all of the photos and video off of an iPhone within one-and-a-half minutes. The device works with 3000 different phone models and can even defeat password protections. 'Complete extraction of existing, hidden, and deleted phone data, including call history, text messages, contacts, images, and geotags,' a CelleBrite brochure explains regarding the device's capabilities" Popular Mechanics has a short conversation with a 4th Amendment lawyer about the practice of slurping cellphone data, too, though it's unclear if the Michigan police are actually using these devices to their full potential.

police do not want to obtain a seach warrent or look stupid asking for one that even a ham sandwich would reject.

This is no different than lookin inside houses with tech devices and not having a warrent. The USSC said no.

If conservatives here on FR will defend this stuff, then you know we are screwed.

Its what I call the "Law-And-Order-At-Any-Cost-Crowd" and there are far too many conservative and Freepers who joyfully cheer it on. And all I can surmise is that they are ignorant to what is really happening and that maybe they'll wake up one day... if that day requires them to fall victim to the unlawful actions of the police state then so be it... something has to give and folks need to wake up and see that the police are not your friends.

They are infact armed agents of the .gov that is so out of control, the same .gov we all rail on here day in and day out. Why they cannot see the police as part of this same juggernaut is beyond my understanding...

I kinda equate it to those who lived in the cities and towns near the concentration camps. They all knew full well what was going on. Many supported the practice while others just kept quite... maybe out of fear they would be next.

Carry a fake cell phone with names and information about current Democrats and what places they went (loads of room there for fun). Store phone numbers of the capitol and some high power representatives. Lots of room for creativity.

The USSC said no.

Since when has that ever stopped the police from doing anything illegal, unconstitutional or just out right stupid?

Also turn it off, so that they can’t scan it.

Seem federal wiretapping laws could come into play here, not to mention that pesky constitution.

No, I won’t waste money on a device that is more annoying than useful.
Not volunteering to be reamed by the Police State is a side benefit.

I do not want to be called while driving, I have a phone at home and in my office, so no need to phone while away from them.
I have computers too, and no need to be online away from home or work.

MY identity and “Self” are independent of others, I do not require a list of electronic “Friends” and “Likes” to know who I am and what I want.

You are welcome to be a slave to an ever increasing number of devices and fads, I have better things to do with my life.

That is the mystery... I understand that conservatives have traditionally valued order. I get that. However I am convinced that an autocratic Royalist inclination has survived Jefferson and the centuries.

This is another reminder that when people say cops wouldn’t follow orders such as to confiscate firearms because they are honest patriotic Americans, well they sure as Hell would. Cops couldn’t give a rat’s ass about the Constitution when they do such things such as this. Why in God’s name would they even want to do something like this much less believe it to be constitutional??

That’s probably the best solution.

Same with your computer. Keep the one you don’t really care about in the open, but hide the one you consider vital hidden away and limit your internet time on it at all time.

No, I won’t waste money on a device that is more annoying than useful.

That's your choice, however, I use it for business and expect Constitutional protection.

MY identity and “Self” are independent of others, I do not require a list of electronic “Friends” and “Likes” to know who I am and what I want.

I wrote "serf"

Yes and far too often I ask Freepers alike how is it that a ruler, any ruler over us, politician, police officer, et al having unlimited power, not a despot?

Absolutely, how is it that the Freepers think that when the times comes the cops will (somehow) differentiate between this unconstitutional action they do without hesitation nor regard to the law, from gun confiscation?

Again it simply passes all logic...

You will obey.....SERF!

Just be sure and ask them for some lube first, maybe even a kiss afterword.

People like you make me sick.....oooh please place the chains lightly upon my wrist, then feed me.

You must live in a different reality than I do.

“Serf”, hardly!

A serf would not have the gumption to ignore the fads of the day, they would be desperate to “fit in”.
A serf would not know most of his states senior politicians on sight, and they him.
A serf never would have instigated and organized a rally of thousands on the state capitol steps.
I’ve fought this sort of police state garbage for decades.
You have no clue who I am, you need to marshall some logic in place of trivial and ignorant insult.
This particular outrage is no surprise, I used to have a job in the telecom field.
I’ve personally installed software patches to enable similar snooping by Gov. Org. on Voicemail systems!
This is not new, just another venue created by new technology.
