Based on postings by people from New York, it appears he received the highest sentence the state hands down for murder.
It appears ‘25 to life’ is the MAX sentence the judge/jury could give him.
It comforted me just a little bit to learn that, as New York law is currently written, his parole will not be based on a sentence of 25 years (which might allow him to be out in as little as 12 years or so). Apparently, ‘25 to life’ means that 25 years is the MINIMUM sentence he must serve before he is eligible for even his first parole hearing.
The dumb ass must have forgot that he wasn't in front of a Pakistani judge.
At least he succeeded in his mission to enlighten more Americans about the true nature of Islam.
There’s a defendant in New York named Leuel Smith. Smith went up on a plea arising out of the murder/robbery of two 60 something married people who ran a Christian Science Reading Room in, I believe, Albany. As part of the plea, Smith cleared THREE other murders he had committed. Got two 25 to lifes.
While in Greenhaven, Smith raped and murdered a female Corrections Officer named Donna Payant. He actually smuggled her body out in a garbage bag and she wound up at the dump where she was subsequently found. That’s murder number SIX.
Under the then existing Death statute, Smith was eligible for execution after his conviction for the crime. That presented a problem for then Gov. Mario Cuomo, running for re-election. The police unions wanted this asshat executed. Cuomo, who spoke out passionately against state sanctioned executions [except, of course, for the unborn]was jammed uip.
Enter Cuomo appointee to the New York State Court of Appeals, Judith Kaye. Kaye’s opinion, supported by a majority of the Court [I forget how many] struck down the statute as unconstitutional [under the NYS Constitution, thereby foreclosing an appeal to the USSC], but found the evidence sufficient to convict him of Murder 2. she then gave him another 25 to life. Consecutive. For his SIXTH friggin’ murder.
Fast forward to the 1990s. My office [I was a prosecutor for 26 years] crafted the last death penalty/ capital statute passed by the New York Legislature. We suspected no one would ever be executed under its provisions, because our legal elites don’t like capital punishment. My county had three guys on death row, including a serial killer. Statute tossed. By now Chief Judge Judith Kaye.
So in New York judges on Appellate Courts that matter don’t spit on graves. They urinate.
And it’s not just judges. Gov. Pataki had to have the State AG take over a Bronx case of [multiple?] homicide, when the elected DA REFUSED to consider applying the death penalty.
That’s what I was thinking. It should have been life, or execution, which is what I prefer. I don’t want to have to pay for this scum for the next however many years. He’ll cost us millions.
