Clearing the Smoke on Obama’s Eligibility: An Intelligence Investigator’s June 10 Report

Editors Note: In December ‘08 a retired CIA officer commissioned an investigator to look into the Barack Obama birth certificate and eligibility issue. On July 21, 2009 westernjournalism.com obtained a copy of the investigator’s report. Here is an unedited version of the report.

The Territorial Public Health Statistics Act in the 1955 Revised Laws of Hawaii

I think that I now understand the legal background to the question of where Obama was born.

Let’s begin with the statement that Dr. Chiyome Fukino, the Director of the Hawaii Department of Health released on October 31, 2008. The television and print media used this statement as a reason to prevent and treat with contempt any investigation into whether Barack Obama was not born in Hawaii. But the language of the statement was so carefully hedged and guarded that it should have had the opposite effect.

“There have been numerous requests for Sen. Barack Hussein Obama’s official birth certificate. State law (Hawai‘i Revised Statutes §338-18) prohibits the release of a certified birth certificate to persons who do not have a tangible interest in the vital record. Therefore, I as Director of Health for the State of Hawai‘i, along with the Registrar of Vital Statistics who has statutory authority to oversee and maintain these type of vital records, have personally seen and verified that the Hawai‘i State Department of Health has Sen. Obama’s original birth certificate on record in accordance with state policies and procedures.”

It is understandable that after such an apparently definitive statement most news outlets, whether conservative or liberal, would accept this as sufficient grounds to relegate the controversy to the status of a fringe phenomenon. Unless they happened to take the trouble to look into the “state policies and procedures” as laid down by the relevant statutes. If they had done so, they would have seen that Dr. Fukino’s press release was carefully hedged and “lawyered” and practically worthless. But the media in general should not be faulted. The statement seems to roll out with such bureaucratic certainty and final authority. I believed it to be significant until a Honolulu attorney mailed me the relevant statutes. I was so surprised that I laughed out loud.

Show me the law that says a President cannot hold two passports or dual citizenship.

The requirements to be President are in Constitution Article II, Section l, and “Natural Born” is described in 14th Amendment; Title 8 US Code: Section 1401.

Where does it say to run for President you cannot hold citizenship in two countries. or two passports?

First of all, there are many Americans who have lived in other countries, who met residency requirements for citizenship, although born in USA. As long as they did not have to renounce their United States citizenship and could hold dual citizenship, and were born here in USA, or according to the laws I noted above, then they are eligible to run.

Find the law that has prohibited Presidential candidates, or Presidents from holding two passports or dual citizenship, as long as natural born in USA, and I will apologize. I don’t claim to know it all.

I think the “age of consent” was no higher than 16 unless Hawaii was different from the mainland states. At first guess I would expect that it may have been lower in Hawaii rather than higher.

I could easily see the birth announcement being done just to try to prevent anyone questioning his citizenship. It didn’t have to be as some nut suggested that his mother was making plans for him to run for president some day.

As for smuggling him in, if she was reentering the country as an American citizen with a valid passport and carrying her infant son I doubt there would have been a big problem.

You can be sure that if Obama were republican and a conservative, DAN RATHER would be all over this story like a bad smell....

As witnessed by the need to pass a resolution for John McCain even though he was born to TWO American citizens simply because he was not born on American soil. They probably would have tried to disqualify McCain if they thought there was any real chance he could have won.

I have a certified copy of my birth certificate, with correct seals and signatures issued for specific purposes, and I have my original and they do not look anything alike.
And I am sure there is a copy in the computers of the state, and that may not match either of the above. So unless someone has the Kenya BC, this isn’t going anywhere.

That might be what he is or isn’t hiding, whether he was born in Haiwaii or in Kenya. However I think the real thing he is hiding is the fact that he used his Indonesian passport and the Name Barry Soetero to fraudulently apply for and get grants to the private school in Haiwaii and Occidental etc. I think his statements that he was foreign born is much more damning to the people of America than whether he was born in Kenya or not.
That is why they tried to scrub his passport file and that is why his grandmother filed for social security numbers under a variety of individuals that had the same name but were deceased.
They made his identity and if nothing else, representing yourself as foreign, means you have willingly given up your citizenship.
