Impeachment of Obama under Logan Act: but which of his violations?
October 10, 2008 | vanity

Posted on 10/10/2008 6:57:17 PM PDT by topher

Barack Obama went to Kenya in 2006 for campaign for Raila Odinga. That would be considered the first violation of the Logan Act.

The other violation of the Logan Act would be the secret dealings with the Iraqi government by Barack Obama to delay troop withdrawals by the Bush Administration.

Interfering with Iraq at a time when US Troops are in harm's way is a very serious offense for a US Senator to be involved in.

I believe both charges could result in Impeachment hearings for Barack Obama -- whether he wins or loses the election.

In my mind, there are two distinct and very serious violations of the Logan Act. Though I do not believe that Barack Obama would be criminally prosecuted, he could be impeached under this offense.

In terms of campaigning for his cousin Raila Odinga, and the ethnic riots that broke out after the election in Kenya, Obama must bear responsibility for those riots.

He endorsed and campaigned for his COMMUNIST cousin Raila Odinga. When his cousin lost the election, the people in the winning party were victimized and murdered by the followers of Odinga. This is a man that Obama supported.

The other violation of the LOGAN ACT is more severe, as it directly impacts the lives of US Service personnel in Iraq...

How sleazy have we gotten in this country. Just think about this. 95% of everyone lies, we have people being killed in the streets, drugs, anything goes. The end justifies the means. We have lost our moral compass because we have allowed through compassion the great satan to take over the world. Call me a nut case but I do think we are in the end times.

The Logan act has been on the books since 1799, but it has never been enforced.

The only Logan Act indictment occurred in 1803. It involved a Kentucky newspaper article that argued for the formation in the western United States of a separate nation allied to France. No prosecution followed.

That is true. But the problem is if one political party in the US makes a deal with a foreign power, and undercuts the Executive or Legislative Branches.

Clearly, Obama was not speaking for the US Senate, nor was he speaking for the Executive Branch.

The law was on the books for a reason...

In the case of Kenya, what Obama did may have contributed to the Ethnic Violence in that country after the election.

There may be people who lack education in other countries that think that since a prominent US Politician (such as Obama) endorses a candidate, then that makes the candidate "a winner", and the election was stolen.

There was the bizarre case during the Clinton Administration of the priest in Africa who thought it was such a great honor to give Holy Communion to President Clinton. Only problem with is that President Clinton was not a Catholic, and Holy Communion in the Catholic Church is meant to be something sacred, not political...

I am in total agreement and will think so even more so if Obama wins. I do not believe Obama is a friend to Israel and I think God has always made sure a POTUS who’d protect Israel was in the WH, so if Obama wins, I will believe that this is part of the end time prophecy. So you are not a nut.

You can not impeach a POTUS who has large majorities in the House and the Senate. Better to get everybody you possibly can to the polls to beat Obama upfront because later will be too late.

As the AG will probably opt out, can a citizen, or group of citizens initiate criminal proceedings under the Logan Act based on published reports??

He can only be impeached if the House and the Senate vote to impeach. At this time, we don't have the majority and who knows what's going to happen in the election. Money is being thrown all over the place and voter fraud is rampant. These are very scary times.

In both instances what Obama did was despicable, and a genuine Forth Estate would make impeachment unnecessary. There won’t be an impeachment, and the way things are going, people will be jailed for suggesting such a thing. Obama is pure scum, a conniving thug who should excoriated in the media. He is also a black man with a Harvard education, and the left can pass him off as an intellectual that can close the book on American racism and slavery. He will accomplish the exact opposite, but then the leftist media can blame and persecute conservatives. It’s a win/win situation for them.

You are right and i agree...if he wins we are in end times...

Then again- at times it seemed we were in end times when JFK was in office- little did we know that was the Apex* of the presidency which has gone downhill ever since (except for the Reagan years)...

* I have another word in mind but cannot remember it..I think that defines old age- you remember the dang word 2 days after you could have used it...no, it’s not ‘zenith’ either...:-) )

He should not be allowed to get away with going to Kenya to campaign on our tax dollar for the murderous, Islam-backed Odinga. This is OUTRAGEOUS.

And not a d*mn word about it from the McCain camp or anything else.

It’s becoming obvious McCain has given up. I can hear it all now, ‘My friends, we ran a respectful campaign, but..’

NOT IF WE ON FR, RUSH, HANNITY AND FOX HAVE ANYTHING TO DO WITH IT! WE’RE NOT TURNING OVER THE WHITE HOUSE KEYS TO BARACK HUSSEIN OBAMA. H*LL NO.

FReep McCAIN/ MSM OUT.

HOW LONG CAN THEY IGNORE A MILLION EMAILS??

.

McCain is losing this campaign because he refuses to fight Obama and his lies, and dirty tactics such as ACORN voter fraud. He’s just been rolling over (or bending over, I should say) and accepting the abuse heaped upon him- and expecially Sarah Palin.
The anemic attempts by the McCain camp to fight back within the last few days just ain’t gonna get it.
He should have been hitting Obama back hard months ago.
He needs to get out there every day and FIGHT BACK.
Email Republican headquarters/McCain.

FReep ‘EM OUT!

CAN THEY IGNORE A MILLION EMAILS?

REMIND McCAIN THAT HE HAS AN OBLIGATION AS OUR CANDIDATE TO FIGHT BACK!
To h*ll with bipartisian BS!
To h*ll with PC!
To h*ll with ‘conducting a respectful campaign’as McCain has said, and vowed to do.

RESPECTFUL CAMPAIGNING WENT STRAIGHT OUT THE WINDOW WITH OBAMA’S NASTY, BRUTAL COMMENTS SUCH AS;
‘lipstick on a pig’ and ‘You can wrap AN OLD FISH in a piece of paper called change. It’s still going to stink after eight years.’

Take off the gloves, McCain!

Hit the Marxist/Muslim hard with Ayers, Acorn, Violation of Logan Act, abortion, 2nd admendment, Campaigning for Odinga!!
Get off the d*mned economy issue. State that Obama/Democrats/ACORN caused this meltdown. State McCain offered a proposal to avert the meltdown and GET OFF IT.
Obama is counting on keeping this going to take the spotlight off his sordid past and dirty dealings!
NOTHING is more important than waking America up to this Marxist/Muslim!! DO IT. EXPOSE HIM!

I do not think that Senators can be impeached. They can, probably, be expelled by the Senate.

My God, doesn't anyone read the Constitution anymore?

Senators cannot be impeached. They can only be removed from office by vote of the Senate itself.

I am not saying he will be impeached.

But I am raising it in the possibility that it might be mentioned on Talk Shows.

Maybe this is in the noise level, and may not be worthy of discussion. I personally think otherwise.

It also gives a chance for the Logan Act to be discussed.

“can a citizen, or group of citizens initiate criminal proceedings under the Logan Act based on published reports??”

No. It seems that we can’t even sue to prevent a constitutionally unqualified person from becoming President. No “standing”, you know. Weep for the America that once was.

When was the last time the Logan Act was actually enforced?
It another dead letter.

Didn't Jesse Jackson & Bill Richardson violate this act with impunity ?

I am not aware of any convictions or even prosecutions under the Logan Act.

I am incorrect in my title for this thread. Impeachment, from Article II, Section 4 of the Constitution is:

Section 4. The President, Vice President and all civil officers of the United States, shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors.

Obama is a legislator, not a civil officer...
