Freepers Help! Another Eminent Domain Theft

The Halper Family's farm in NJ since 1921 is being taken through eminent domain today. Mrs. Halpert says dems and reps make money by having arrangements with developers.

The open agreement between the town and the county says they can "sell lease or donate", which is" doing whatever they want."

Mrs. Halper said it was "to make more money not necessarily for the town but for themselves..."

Her attorney stated, "Major developers throughout the state are benefitting from their relationships with peope that are in the Democratic party or the Republican party, and through that connection they're becoming pricvate developers for property taken in open space, and they're using it for their own private purpose."

Sean Hannity said, "This is almost legalized stealing. This is scary that this is happening in America."

Not ostensibly for development, primarily for recreational open space--just because they could. The family was awarded $17 million by a jury for the tenacres, but they say they don't want the money, bless their hearts.

The husband has been their his whole life, the mother for the last 19 years, and their four kids have been raised there.

They should take the $17 million, then find some enviro wacko to find some rare bug on the land, preventing any development, then apply as a caretaker of the land, offering to take the job for free and stay on the existing residence.

I sympathized with the Halpers until I learned they were Democratic Party contributors while these eminent domain proceedings were going on. Now?

But shouldn't we take the high road and be the ones protecting all people from wrongs? Would I want the Dems in power not helping me if they found out I was Rep?

Why should anyone be surprised at this? These arrangements are what our government has degenerated into. They also do this with jobs (I won't go into details). If someone wants your job, they arrange things behind the scenes to legally take it. Doesn't matter which party they're in or you're in. When a person tries to fight this theft, they find they're facing the full legal structure of the masters of our society, and they don't have a chance.

The Fifth and 14th amendment of Constitution allows it, and ensures that private parties are justly compensated for. Issue is, for what use?

For many states, condemnation procedures were born from railroads acquiring land to lay tracks.

State legislatures then conveyed authority to other state and local entities: Urban Renewal Authorities, parking facilities, airport expansion.

The main complaint is condemning private property for future private use (i.e. home developer). However, the condemning authority can claim that new property tax roles helps local infrastructure, thus is a public use. This debate continues to be hot.

$17 million for ten acres?! Buy a Steve Miller CD and head out. People shouldn't be so wedded to memories that they miss the big pay day.

Hasn't anyone heard of freedom to have and keep personal property? How can we be a nation of freedom, an example to the world, if we take it away from our own citizens?

(I as going to say 'have and maintain,' but 'maintain' reminds me uncomfortably of my yard's weeds!)

They are under court order to be out of there today. To me, this sounds like a Schiavo case--killing someone when you have family willing to care for the person; stealing land when you have the family still wanting to live there. Of course I'm not claiming a person is equal to a lot of land, but the concept is that it's still brute force taking over through law to do something wrong.

A local resident is having his bar taken by ED. I had wanted to post it here the other week, but I wasn't sure about the newspapers posting policy.

It is The Tiki Bar in Earl Twp PA. His bar is right near a creek, but his place is built on stilts. 5 or 6 other homes are being taken too. Hazard from flooding is the excuse.

The township wouldn't have thought of doing this before the Supreme Court ruling, but now it seems the governments feel they have Carte Blanch to seize property.

I feel the story is just starting and I was planning on trying to get him some more exposure and when I can get more info, I'm going to contact some of these other people in the same situation around the country.

The land is to be used for passive recreation.

The sneaky dirty little secret is that the town is taking this land for 'green acres' so they can turn over other land designated for that purpose....to a developer.
