Does it matter? Yes...if it was one of the 5....one might have to recuse...and that would make 4-4...and Roe would stand.

Would that cut both ways? If it was one of the minority 4, should they recuse and make the ruling 5-3?

Was a more current opinion issued that we don't know about?

I wonder if they haven't really decided and maybe there was an assignment to one of the liberals to write a ruling, which wasn't leaked, that keeps Roe and the final decision won't be reached until they've heard the arguments in both papers. Just wondering - I don't really know how the Supreme Court works.

Specifically, there's a picture taken at a wedding of the intern with the Politico reporter who reported the leak. Tellingly, the intern has deleted that photo.

Yes, and Breyer’s clerks appointments end when he steps down, so if the clerk was one of his and can evade detection until end of term, the can move on with no damage.

Possible, but it would be a horrible disservice to Richard Jewell the wrong person, who could lose a law license and a career. Need to be absolutely certain before using names.
