There was no need for the /sarc tag. Kamala Harris is NOT an Article II eligible natural born citizen, her birth status is precisely the same as Wong Kim Ark, the subject of an 1898 SCOTUS citizenship case wherein the court held that he was a CITIZEN (not natural born) by virtue of the 14th amendment, which did not exist in 1787 when Article II was ratified, and which also does not refer to or modify in any way.

That issue is hiding in plain sight, and everyone with the responsibility to have this matter adjudicated by an Article III court has gutlessly abrogated THAT obligation.

Even if legal (and it is not) the Recall is less than two weeks away. There is not enough time for that to work.

Interesting, but Newsom wouldn't be confirmed before the recall election.

However, he could still resign but there is no guarantee that he'd be confirmed by Congress to be the next Vice President.

His best roll of the dice is to remain in office and take his chances with the recall election.

Pelosi will (in a stunning reversal of her modus operendi) OUT Harris to get her out of the line of succession
Leaving Pelosi as President of USA.

Neither Pelosi nor Harris would choose Newsome for Veep or anything else, however, he’s last year’s roadkill in political terms

A correction to my previous post. Presidential Electors cannot vote for two persons from the same state *as themselves *.

From Article II of the Constitution: “The electors shall meet in their respective states, and vote by ballot for two persons, of whom one at least shall not be an inhabitant of the same state with themselves.”

Anyway, no Electors are involved here. So it could fly.

BTW...

A similar situation happened in New Jersey with the election between Bob Torricelli and Doug Forrester in 2002.

Torricelli was behind in the polls as his scandals were catching up with him.

Rather than risk losing his seat to the Republican, the Torch resigned and Frank Lautenberg was appointed to fill his seat. The New Jersey Democrat party also petitioned the court to swap Lautenberg in place of Torricelli on the ballot. Republicans complained, stating that absentee ballots had already been sent out and were being returned, in other words, voting had already begun.

New Jersey being Jersey, the court sided with the Democrats and ordered new ballots to be mailed out with Lautenberg on it, stating that "voters deserved a competitive election." This was despite the fact that New Jersey voters had a competitive election and disliked the candidate that the Democrats ran.

Apparently, to Democrats, a "competitive election" is one where the Democrat candidate is ahead. If the Democrat is behind, then it becomes "the voters deserve a choice."

Forrester lost, and Republicans were denied the seat. Can the same thing happen in California if Newsom decides to resign ahead of the recall election to deny Larry Elder the win?
