It's been a while since I read the details. I wouldn't be surprised if it has to do with a technicality that that part of Oregon's beach was considered a roadway and, therefore, part of the local DOT's responsibility.

There was one man who spoke to the crew chief about blowing up the whale: told the crew chief that it was going to be a disaster but was ignored.
