Obama’s First Executive Order Strikes a Blow for Transparency and the Rule of Law

In a world where political symbols matter, President Barack Obama chose a worthy subject for the first executive order of his new administration. His first executive order, entitled “Presidential Records,” revokes Executive Order 13,233, President George W. Bush’s constitutionally lunatic procedure for enabling former Presidents and Vice Presidents to limit public access to their records. The obscurity of the subject does not diminish the importance of what the new President is signaling. A statute called the Presidential Records Act (PRA) gives an executive branch official, the National Archivist, custody of a former President’s records upon the conclusion of the President’s term of office. The PRA requires the Archivist, within specific procedural guidelines, to make presidential records “available to the public as rapidly and completely as possible.”

New laws over ride old ones and this is just a way to cover a Presidents tracks. Folks we are being destroyed by the so called Rule of Law.
Trump needs to go in and reveal all the crooked underhand dealings of Obama. That is why the Democrats thought it was imperative for Clinton to win to cover up all their crookedness.
What good is the Rule of Law when it allows people to come in here illegally and demand rights that our forefathers fought and died for us.
Illegal aliens are marching in America’s streets looting,burning and demanding rights. Wake Up America you are being overthrown by your government from within.

Every single one of Obama’s executive orders should be canceled, then take them out and burn them. If there is a acceptable phrase or paragraph in one or two of them, then issue a new Trump Executive Order that incorporates those phrases or paragraphs.

The process should be a little more involved than a blanket negation. Each one should be examined, pros and cons, the legal foundations (or lack thereof) behind each and then cancelled with a canceling statement.

That statement should echo what that FBI Director Comey said in deciding ALL of the 650,000 emails on Weiner’s computer weren’t relevant.

The Democrats are going to litigate these cancellations up to the SC - let’s make them do them one-by-one.

I have no problem cancelling all of Obama EOs one-by-one.

But I don’t see any legal claim for which Demonicrats could litigate such cancellations, unless an executive order had been initially required by a law passed by Congress and signed by the President, or subsequently had been incorporated into a law passed by Congress and signed by the President.

Of course there are executive orders that deal with trivial actions in the past (like the annual pardon of the White House turkey), which are now pretty much irrelevant.

Understood, but they have done this in the past IIRC. I’m just saying the rescission statement should contain some sort of reasoned legal basis if that is possible.

The DEMOCRATS will fight the rescissions tooth and nail, take it to the bank.

We could start a whole thread on EO's and their place in government but for a simple explanation an EO's authority is for the executive branch only.

Now having said that we can point to a number of them throughout history that do go beyond that branch, but as I mentioned that could be a separate thread.

Zippo's first EO only covers records he in responsible for during his time as POTUS, period. And yes any EO can be nullified with a new EO.

Obama has a good reason to kiss president Trump's ass, self preservation. His legacy is in tatters but he's worried about the truth getting out. I hope president Trump scraps that executive order blocking the records. Let the sun shine in so the roaches scatter.

As I said we can point to instances that go beyond the executive branch. Your inference implies that EO's have authority over another branch. That simply is not so.

The executive branch's responsibilities, among others, is to enforce laws. EO's can be used to allocate resources to that end, but cannot make law. Do some EO's have the same effect as law? Yes. But again we do a whole thread on this topic.

My original point is the EO of the subject of this thread has no impact beyond how the executive branch handles his presidential records.
