Hasenhuettl was advised of the papal reminder, understood it and proceded on his own volition. Does this constitute a mortal sin?

I attended a very similar service in the diocese of Richmond, Virginia, only the priest didn't get into any kind of difficulty with the bishop. Either he didn't know or it had his approval.
